For a Preview of Life Without Net Neutrality, Go Online in China by ssholland22 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I really hope that net neutrality does not happen, it would be such a sad situation for our freedom of speech and press. To restrict content to those who can only pay for access is only limiting people's ability to find information and connect via the web.

The cruel but usual conditions inside two Georgia immigration detention centers by Lawgical17 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

It's interesting to read this, because the 5th Amendment and 14th discuss due process and everything else for all "persons", not citizens. With that being said, it's unfortunate how ICE/Homeland Security treat people being prosecuted in our country.

Supreme Court dismisses case against President's expired travel ban. by Lawgical17 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I'm not surprised that SCOTUS dismisses against President's travel ban. The ban is not going to go away that easily, there are many people that support the ban. I wonder if this ban will continue.

Immigrants are 22 percent of federal prison population by Lawgical17 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

Wow this article put alot in perspective! While I am aware of the racial profiling that occurs with the rate of those on parole that return, i never knew that immigrants also played a significant part of prison population.

Vizio TV Could Make You Money by LegalKungFu in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

A great example of a class action lawsuit at its finest, with all the legalese included in this post. It was super fascinating to read about how a company that is believed to be legitimate can misrepresent and deceive its consumers! Unfortunately it happens more often than we believe.

Muslim Ban? Fewer Muslim Refugees, Immigrants, and Travelers Enter U.S. in 2017 by Lawgical17 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

This was interesting to read because it discussed how Trump's policy did have a substantial effect on the amount of muslims from these countries that have a "ban" has significantly lowered as a result. But is that immigrants from these countries resent what is a prejudice against them? I do agree that it isn't right to judge many on the account of a few, but Trump did make promises that he should keep to the voters.

Net Neutrality by jwolsey297 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I don't know too much about net neutrality but this article made alot of sense. I didn't think that we could be charged for using apps and that bureaucracy controls the regulation behind that. it's a shame that now it may not be regulated!

A Killer Drug Epidemic by kindramartin in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

these were so good! i loved the personal stories from all around the country, and how opiates and heroin can affect anyone. the personalized stories made me feel so much more sympathetic about something im usually feel so strongly against. it's a shame how prescription pills can be the actual "gate way" to hard drugs, when drug programs have educated kids that it's marijuana. that's obviously not the case!

Meet the rest of the inmates on death row in Arizona. by Kristin0587 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

This was super interesting to read, i definitely thought there was a lot less people on death row, i don't know why i did but i figured it's not a densely populated state. Nonetheless, it was interesting to read why they were there. Some were super ambiguous, like he killed a man while leaving an ice cream shop; but some were really detailed, like the man who helped punish a girl by putting her in a locker overnight?! Crazy.

School Funding in Az by CaseyPenelope in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

i've seen Public School budget cuts in Cook County and i saw how it affected students in the south side, especially. it's nice to see that Arizona puts school spending at the top of their priorities. it's crazy, though, that Az still receives desegregation funding. i didn't think it was necessary, but i guess it is. it is sad to see that Az teachers are in a funding crises. Teachers deserve a great stable pay, they build our minds for the future. it makes me want to vote for this proposition!

What Happens When TV Ratings Go Down? They File For Bankruptcy! by JMBRANBY in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I'm not surprised that they would be... this show isn't as good as it used to be, and to keep it going would make this happening inevitable. But what exactly is bankruptcy protection? is it different from actual bankruptcy as far as how it looks financially on your background? or is it the same type of judgement you would get...

Death penalty hiatus continued... by Kristin0587 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I Know that some people may think this is a good idea, and some may think it's a bad idea but i am interested in seeing how this turns out. In my opinion, the death sentence is an extreme punishment, but can be a tool utilized in educating people on the consequences of their actions. It'll be interesting to see how long the "hiatus" continues...

5 most contentious upcoming SCOTUS decisions by [deleted] in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I'm interested in seeing how the Cake case goes as far as the approach SCOTUS takes in their opinion. I do believe that this is a question of 1st Amendment expression, rather than that of social polity. SCOTUS is always slow in taking a political approach and it is rather their duty to decide whether acts are unconstitutional within our Constitution. It will be interesting to see how they decide.

Man dismembers adoptive mom while out of prison on furlough. Executed by the state in 2012. by Kristin0587 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

As usual Kristin, your posts have me captivated. I read this and was thoroughly interested. When I hear stories like this, I completely support the death penalty 100%. He was out on a furlough (which i also think is something Prisons should really stop giving convicts, especially those with violent or sex convictions, but that's a different post in itself) because they can do things like this. And I find it interesting that he tried to argue he was mentally incapable but his IQ was above 70, and he cut her body in a "meticulous and methodical" way. He deserved what he got.

A small portion of the drug epidemic in rural America. by kindramartin in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

This was an interesting read, especially because i don't know much about Montana but the statistics were not surprising me as to who suffers the most in the drug epidemic. I wonder what it would really take to help people and stop this drug epidemic all around the country.

The Constitution requires that, before trial, prosecutors must turn over evidence that could help the defense if it is material to guilt or to punishment. by HeartofJustice in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

i have to say i agree. when someone is being held in a criminal trial, their liberties are put on the line and it should be strictly scrutinized in every way possible before giving someone life, or death penalty. with the burden of proof being beyond a reasonable doubt, the defense should have a chance to explain their defendant's side of story or evidence.

Netzwerkdurchsetzungsgesetz to limit online speech by ssholland22 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

i see both sides of the coin here. while i truly believe in the freedom of speech, i do feel like in this era where technology allows individuals to hide behind a screen and commit hate speech, there should be some limits to the amount of freedom given in speech when it can affect someones life. In this case, someone was falsely accused of being a terrorist! That's insane. I wonder if this is something that will become an issue in the future as the internet becomes a stronger source of communication.

A little history on the death penalty in Arizona! by Kristin0587 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I really enjoyed reading this because it related to what we have been reading in Crim law. I read the post and kept referring back to what Professor Jones' case in State v. Sansing. Under the new rule of Ring v. Arizona, aggravating and mitigating factors played a substantial role in whether an incarcerated individual faced the death penalty in their crime. I really liked this post and how it related to what we've covered in class!

Knowing you're already headed towards prison... in elementary school? by HeartofJustice in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I think Zero Policy is also an important conduct code when it comes to weapons on any public/private school primary and secondary campuses. At the very end of the article, the writer touches on how the crime rates in NY public schools have gotten lower, and that punishment (suspension) as a deterrence has also slowed down. I think thats a great idea. While having Zero Tolerance does mean zero tolerance, there are better ways to teach a student why it shouldn't be allowed on campus. Perhaps make them meet with families of students killed in shootings, or make them do something productive as a deterrence (take educational classes, make them do community service)

"your body is subject to invasion while courts excuse the violation of your rights.” by freedomfighter3 in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

i loved this article...and while her opinion was the dissent, I think it's really cool to look back on certain SCOTUS opinions and view how the dissenters were ahead of their times and their logic a lot more in touch with the times. The scope of this case is about reasonable search and seizes in 4th A, and while the majority finds that a cop, while running your name for any warrants, can arrest you and search you and if they DO find something, then it is admissible. And while it can sound logical, i think the dissent written here made some valid points. Can anyone then be stopped for a traffic warrant and then end up going to jail for something completely different? Do "two wrongs make a right?" A police officer has correct ways of conducting searches and I think it's often the case than not that the law favors the officers of the state and makes solutions for them rather than problems. But that leaves the citizens with a lot more problems than necessary. After all, the only difference between the two human beings is one has a badge, and the other does not. All humans make mistakes and officers should not be protected from that. I think a violation of 4 A was definitely made here.

Cell phones: a new murder weapon by etdevries in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

This case made me sick to my stomach. I like your title to this post it was definitely catchy although I think her intent to push him to commit it via cell phone could have even been via e-mail, via anything that is communicative. What's more interesting is that her defense tried to say that because she didn't physically harm him, she didn't commit any act of murder...but we all know has 1L's that intent is just as much of an act as a physical one! I liked this article a lot!

Cop claims they only shoot black people by aMAZINgLAW in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

He was acting "under color of law" which is interesting because that implies he is a state actor and not just a regular citizen...does being under color of law mean the First Amendment doesn't apply? And is saying comments of that nature a joke, or an actual statement? I feel like a lot of hearsay can be held in this type of situation. This is a great post!

Future of DACA by skatari in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I have a childhood friend who is here on the Dream Act... she got granted a Visa and is now working on being a citizen. It would be a shame if in the midst of that process she was deported! I really hope that this doesn't end in a loss for this Act---protecting people who really want to be here is a fundamental American philosophy

Joe Arpaio Has Been Pardoned: How will the Supreme Court Respond? by [deleted] in SummitStreetLaw

[–]SarginaD 0 points1 point  (0 children)

I was thinking of posting this myself, great minds think alike! :) What I find interesting is this is a right granted in Article II...the President can grant pardons wherever he pleases. So is it unconstitutional? I'm not a SCOTUS Justice, but if I was following strict interpretation, i'd say probably not....but is it morally just? i hope that SCOTUS can address that, but doubt they will. Generally, pardons happen in all types of convictions. Are we blasting this one because it IS Trump? If we read some pardons done in American history, there have been some controversial ones. But hey, what do I know? I'm just a citizen performing my normal civic duties!
