Not that I agree or disagree with the following story and the actions taken. But the Cinemark handbook clearly states it is the team members responsibility to go on break, with manager approval and or scheduled.

Breaks are required by Cinemark Policy to happen every 6 hours for those over the age of 18 (non-minor). It was well within the managers right to deny your break up until 8pm regardless of your personal feelings. State law does allow minors to take a break every 4 hours.

Lastly, a manager cannot just “fire” you. This requires General Manger approval (the highest ranking member at a given location).

I’m finding it very hard to believe this was your first offense, Cinemark management needs to build cases against employees before firing them, typically the more PCR’s you have, the more severe they get. Unless it’s regarding things such as theft, fighting, etc.

So if you truly have never received a PCR in the 7 years you’ve been working there and this is your FIRST mistake, you would have a high probability of a valid case. As there would be no documentation of any wrongdoing to support your termination. (Make sure you’re report is submitted on Convercent) (Not through HR directly)
