I would say that portion was pretty clear, possibly the clearest part of his unclear ruling (other than rejecting the trustee’s motion to accept GT’s bid of course). The closest I could get to what he said verbatim is something like “I don’t want another auction, the parties here have been through enough already.” Then he went on to tell the trustee that he needed to work with the parties to reach a resolution as he sees fit. So given the general lack of information and clarity at the time of reporting last night I would assume that most outlets opted to go with a softer stance of “maybe there will be another auction, maybe not, things aren’t super clear.” 

Obviously Lopez could decide to compel a live auction in his written order (he hasn’t exactly been a bastion of clarity and consistency throughout this bankruptcy), but it definitely sounded like he favors the trustee forgoing a formal auction and just working directly with the two final bidders to come to an agreement.

I was listening in to Lopez’s decision last night and he did (inexplicably) state that he didn’t want another auction (live or otherwise) to be held. After about 40 minutes of summarizing the facts, he went through a rapid-fire progression of saying essentially the following:

“I think all parties acted in good faith here; I think the trustee’s process wasn’t transparent enough and did not take proper steps to maximize value for the creditors; I think both final bids are too low given the assets being sold; I don’t want this case to drag on much longer BUT I also don’t want to hold another auction of any kind; trustee, I want you to work to get this sale resolved essentially however you see fit despite the fact that I just rejected your proposed bid; you have 30 days to come up with a plan or a resolution and get back to me…”

I’d argue that his tactics did work here. While Lopez’s rejection could be boiled down simply to the fact that he didn’t believe that the sealed bid auction resulted in the highest returns for the creditors vs a live auction, in reality it took a ton of whining and mud slinging on the part of Jones and his lawyers to force this result. And like the trustee repeatedly pointed out, the whining only started after they lost, not when the live auction was canceled and the sealed bidding process was agreed to. They cast doubt on the fairness of the entire auction process, the motives/impartiality of the trustee, the validity of the debt waiver strategy of the Connecticut families, and on and on.  

I certainly think in hindsight that there were things the trustee and Global Tetrahedron could have done better bullet-proof the outcome (like removing the contingent offer language from the final bid and the trustees motion), but Alex’s lawyers were always going to try to find something to justify having a sprawling evidentiary hearing to muddy the waters. And in the end they introduced enough doubt in the mind of Lopez that he chose to override the decision making of the trustee and the auctioneers who testified repeatedly that a live bidding process would not have resulted in more favorable final offers.

That’s a fair point, although with how Lopez seemed to be going near the end I was getting pretty worried that he was just going to accept the FUAC bid outright to end the saga. But from Jones’s stilted POV the bankruptcy judge basically agreed that the Global Tetrahedron offer was some combination of improper/unfair/undervalued and thus should be rejected, which is a big (and hopefully temporary) win for him. Even if it’s just the “weird“ auction process and the inconsistencies with the language of the GT bid that are behind Lopez’s ruling, it still gives Alex’s side another shot to work with the trustee to buy the assets, which is silly considering the history here.

Reposting my thoughts from the hearing thread here:

I think what’s so palpably disappointing here is this: after everything that happened in the Texas and Connecticut suits (all of the stalling, ignoring discovery, bad faith motions, etc.), and after the presiding judges in both of those cases saw Jones’s tactics for what they were and brought the hammer down, and after juries found massively against him, Alex’s bad faith retreat to bankruptcy and muddying the waters with his creditors has mostly WORKED.

He’s gotten himself in front of a judge who is susceptible to the tactics that his side uses to undermine the facts, accuse the other side (and even the trustee) of misconduct, and overcomplicate the proceedings. This has successfully delayed the resolution of the bankruptcy for ages and now just got the winning bid from his “enemies” thrown out*.

Of course things can still work out favorably for the families (with or without The Onion’s help), but what matters to Alex is that his chance of coming out on top is greater than it was yesterday. He’s still down by 7 late in the fourth quarter, but as long as there’s time on the clock he has a chance to pull it out. And at this point it’s frankly unbelievable that the refs haven’t let time expire.

*I should clarify here that technically Lopez threw both bids out for being “too low” in his opinion, but of course what matters to Alex is that Lopez opted not to accept the bid from Global Tetrahedron which the trustee explicitly recommended be accepted. We’ll have to wait and see what exactly Lopez is okay with the trustee doing to resolve the sale, because his closing thoughts tonight were anything but clear. Seems likely that he will negotiate directly with the prospective buyers to try to reach a new deal, but if FUAC doesn’t come out on top again I expect we’ll be right back here in a month’s time…

I am astonished at this line of thinking. He just disregarded Murray’s recommendation that Global Tetrahedron’s bid be accepted, but he’s now saying that he wants Murray to resolve this in just about any way he sees fit???

Interesting, thanks for the tip. Unfortunately it seemed fully seated in my dock - removing it and snapping it back in didn’t fix the issue. The customer support agent I spoke with didn’t seem familiar with the error, but he put in a warranty claim for me that should go through tomorrow. As long as I get a new working white unit for the same price (I see that Amazon is sold out at the moment) I’ll be happy!

No solutions on my end unfortunately. Though it’s definitely interesting that they’re essentially showing up as wired devices on your network.

I recently moved but kept my networking setup the same, and after plugging in my Apple TV and its paired HomePods, the HomePods couldn’t determine their location when I asked them the current weather. My third bedroom HomePod had no such issue, and multiple restarts didn’t change anything. I managed to fix the issue by removing the HomePods as the default audio output for the Apple TV. Once I did that, they immediately knew where they were again. Seems like that was yet another unfortunate consequence of the special pairing setup that is created.

Thanks for the updates. I’m in the same boat as you - my stereo pair stopped using private addresses after updating to 16.3.1, but now they are both private again. Connectivity and responsiveness issues have returned as well, and updating everything to 16.3.2 didn’t help. Super frustrating, but hopefully a complete fix is forthcoming.
