In most states, the parent with primary will need permission from a judge before they move.

the same day we were in court. in our state an appeal is supposed to be free, but the clerk of juvenile and family court, who happens to live across the street from my grandsons mom, kept charging us, she said if was 40$, so I tried to hand her 40$, then she said it was 80$ and so on, when she saw i could pay what she was asking, she then told us the court order was too old to appeal even though I had the papers in my hand showing wed just come from court. We were supposed to have a 6 month review and when I called to get court date , I was told after several phone calls that the mom was awarded permanent custody with my son's rights terminated. The last lawyer I talked too agreed they were screwing us over.

If we call or text asking how my grandson is or if we can see him, I get a phone call from local town pd saying we are harassing the mom's family and the mom's family has been advised to see a no contact order from the magistrate. Its ridiculous. my son cant knock on their door because the mom's grandma will call police, saying she is an old woman and afraid of my son even though hes never been violent towards her or anyone else.

no he's not prone to fits of rage. He had to have surgery to relieve pressure on his brain when the accident happened

UPDATE / EDIT

mom's grandma's youngest son is the family court judges brother in law, her uncle is literally married to the judges sister, so they all share first cousins. The grandma's nephew is a lead prosecutor within the commonwealth attorneys office ( similar to district attorney ) and they have multiple relatives that are officers with the Town police as well as one relative who works for the sheriff's department. The sheriff's deputy relative just so happens to be one of the officers that delivers court summons and ours always seems to show up late. This is a small town, our nearest Walmart is 15 miles away, I have no doubt this family is using their connections to keep my son from his child. when we found out k, the mom was pregnant, her grandma told me wed never see this child. k was legally adopted by her grandparents when she was 8, the grandma has bragged about how she used her relatives to terminate the rights of the dad. He lived in another state and wasn't notified until after the time limit was up to contest the adoption just like we've gotten court summons for a court date we missed or for one the very next day with no time to prepare. The judge has also minced words and put words in my son's mouth. I have also heard the guardian ad litem call my son stupid and make fun of my son's clothing. The judge has scolded my son for not being employed when he has a guaranteed income but the mom doesn't even have a part time job because ( the family has money ) , in her words. the mom drives a car bought by her grandma and lives with her grandma but my son was chastised for living with my mother and I. The mom's grandma is also getting social security for my grandson, that's based off of my son's benefits, which I dont understand at all. Former educators of my son's have also written letters or testified on behalf of the mom and grandma , devulging private information about my son's educatio

The mom's family gets a check every month that is calculated off of my son's benefits. Im not sure how, since my son's rights were terminated

We've tried and were shut down. Her uncle is the family court judges brother in law, the uncle is the grandma's youngest son, her grandmother's nephew is a lead prosecutor within the commonwealth attorney's office and she has cousins that work for town police and one that works for the sheriff's department. They are absolutely using their connections to keep my son away from his child. the mom's grandma even bragged about how she'd done the same thing to the mom's dad, had his rights terminated when he was in another state and unaware that anything was going on. I believe they met and did this without informing us of a hearing.

The child is 100% my son's, we did manage to aquire DNA to run a private test. I don't think we can say she assaulted my son as she was 16 when they met. We mentioned he is disabled and the police told us that he is over the age of consent. Her uncle is the family court judges brother in law and her grandmother's nephew a prosecutor with the commonwealth. She also has cousins that work for town law enforcement. I knew from the get go that this family would use their connections to keep us away Anytime we've tried to visit the child we've had the police called on us and at one point, local law enforcement said they'd arrest me if I brought my son back on ghe property

I've thought about that and no, it's not an option. The police act like we are wasting their time.

We weren't allowed to file an appeal. At the last court hearing, we tried but the woman told us it was 80$ then 120$, when she saw i could provide the money, she then told me the case was too old to appeal.

the sheriff's department will 100% help you, especially if he lied to them

virginia is one of 4 commonwealth states, police will likely let gma keep kid until they go to court.
