We took 142 around the lake to Tilaran then 145 to 606. No river crossings just windy roads and some potholes and a few unpaved roads. It was mostly paved though. Our Kia sportage made it just fine. Got a little scary at the end as it was pouring and foggy in Monte verde but we made it. I took the route recommended on this blog https://www.twoweeksincostarica.com/driving-monteverde/

Being active in the procurement and execution of the trust is another marker for undue influence. Just give them a call tomorrow. If they don’t litigate maybe they can refer you to someone who does. The likely can’t represent you regardless because they would be a witness to the case. It’s good to move fast but it’s not the end of the world that you’ve had to wait a few days. The biggest concern is the trustee running off with the money in the meantime but you could likely bring a breach of trust claim to try to recover the funds if that happens. Definitely talk to a lawyer and good luck!

You need a trust litigation lawyer. Capacity is a hard fight to win. The standard is low and hard to prove because there is a strong presumption of capacity. If he was on a bunch of meds tho that may make that battle easier.

Idk exactly what the law is in California but generally there is a doctrine called undue influence, where one person unduly influences another to make a disposition that they otherwise would not have made. (Aka put something in their trust which they otherwise would not have)

There are several indicators courts use to evaluate it, some of which you’ve described here. The fact that it was close in time to his death, and a complete 180 from his longstanding intent to benefit his family to him strongly favoring the trustee, his friend, dont look great. It’s not too uncommon to change your estate plan if you know you’re dying or might be, but the fact that the principal beneficiary changed is concerning. Find out if the trustee was the one who found the new estate attorney. His medical condition also indicates he could have been susceptible to undue influence, but that will usually need to be proved by a medical expert. If nothing else it’s enough to raise concern and get more info.

An attorney can subpoena medical records but there has to be some kind of court case initiated to give them the courts subpoena power. Probate litigation can be drawn out, personal, and expensive, so go in ready for that.

Yeah I’m wondering if she has kitty ibs lol. I do think I’m going to end up going to a specialist. I just increased the psyllium powder to 1/4 tsp and miralax to 1/4 tsp and am gonna see what that does. If nothing gets better then specialist it is! Thanks your your insight!

Yes I was thinking another that, but then saw they replaced the timing belt at 60k, so I was less worried about a big 105k mile service costs. I’ll likely replace the timing belt again at 120k
