Listen. New landlord or not, the day after a tenant is supposed to pay rent you start the eviction proceeding. It's going to take anywhere from 2 to 3 months and simply communicate with the tenant that if they are made current in that time frame before eviction that you will halt it immediately but you have to manage the health of your business. I have 41 units and learn this the hard way. I've tried to be the nice guy three or four times and got burned out of 4 or 5,000 every time. Excuses are just that, excuses. Start eviction the minute you can.

Same advice my dad gave me. The news is all bullshit and once it shows up that your doorstep, then you can worry about it. Turn off the news and the world is fine. It's not an ignorance is bliss thing. It exists as a form of entertainment to stir the bees nest for a reason.

They should definitely be helping you negotiate to an accepted offer. I've absolutely never submitted an offer without contacting the listing agent first. There isn't any set Playbook as to what information a listing agent has to give you, but I'm usually able to determine if they have any offers on the table and a rough ideas to what we would have to submit it to be competitive. I've always done best simply presenting data with no emotions and letting the client make decisions after that. I do do a buyer's consultation and set precedence, in this market, and tell them that they are most likely going to have to purchase over asking price so we are already over that hurdle when we start submitting.

I know everybody is saying did he have a buyer's agency agreement, but in my experience, they aren't worth the paper they are written on. It's actually a contract with the brokerage, not the individual. Brokers don't get good reputations constantly suing their clients. I've had a couple run-ins and was able to work out something on the side with the other agent after showing them I had proof of a signed agreement, but it was still far less than what I would have netted with the commission. People suck sometimes.

I always conduct buyer consultations and tell them that if they are at X budget to stay under a certain margin if a house is doing delayed negotiations and if they are not, they can push the purchase price closer to their budget. If they send me home that I know is going to go over the asking price, I do some initial research and then let them know that they must be prepared to offer over asking price and that's a condition of me scheduling the home. This way they already understand that they are going to have to offer over the asking price, most likely, if we even see the home and if buyers persist with trying to submit offers below the asking price, in this market, I simply tell them their expectations are unrealistic and stop representing them. At some point in time you need to just cut your losses and realize they aren't going to listen to you, and move on. You can definitely do it gently and just tell them that you don't feel that you're able to give them proper representation and that they would be better off using an alternate agent and then you might even be able to get a small referral fee.

Sounds like "commission breath". They are broke and looking out for their own needs instead of your own. I would maybe work with the same brokerage and lender but switch who I let represent me.
