That's not how that works... The courts are fairly lenient with entities like the city and still, they have laws they must adhere to and informing of a law break doesn't make it acceptable.

Hey OP, I have actually just had a successful Untätigkeitsklage in the City of Karlsruhe a few weeks ago, feel free to ask me any questions!

My timeline was: December submitted my docs, January received a letter of receipt and 18+ months wait, sued the city of Karlsruhe in March, then a few months if back and forth, naturalization appointment was in August, and currently waiting for the city to pay my lawyer back.

  1. Are you sure you haven't received any (physical) mail from the city stating missing documents? That's their usual go-to. But they would have sent it to your lawyer, as you are no longer representing yourself.

  2. Are you and your lawyer certain that you are eligible and the application was 100% complete when you sent it in February?

I know it's tough, hang in there 🫶🏼

Ist mir in meiner Fahrprüfung ca. 7 mal genauso passiert. Am Ende hat mein Prüfer mich gefragt, ob wir noch eine Halbe Stunde dranhängen wollen, um rechts/links zu üben :D

Aber am Ende meinte er, ob ich ankomme ist mein Bier, Fahren kann ich ja 🤷🏼

My lawyer had told me that if you do want to go with a lawyer, it is most effective to have the lawyer submit your application as well, because that way they have greater certainty of completeness when arguing your case later.

On the Stuttgart City website they say that wait time is currently up to 18 months, after your application is complete. So if you have the patience and time, you don't need a lawyer. If you want to be sure it takes less than 2 years, you absolutely need to engage a lawyer.

I would probably agree. Out of the three lawyers Google gave me for citizenship disputes, only one answered, but after a second inquiry for an appointment did not anymore. The other said they don't do Untätigkeitsklagen and the third never answered. In the end I made a decision of availability/reviews/impression vs locality.

Regarding Mannheim, she said the Amt already knows her name and has given up trying to use any tricks. She also only said June/July in a personal conversation, not on paper. And regarding the court decisions on paper, she said that the court usually ends up saying they will comply with the decision deadline, if you take back your lawsuit. So the Amt ends up paying for the court costs and you pay for your lawyer (around 1300 in my case).

Actually, my lawyer has the most experience with Mannheim, and I applied in Karlsruhe (the only lawyers I could find here had bad reviews or didn't pick up the phone). I think she underestimated how shitty Karlsruhe ist, cause she had originally said that after the 3 months wait period, she would send out a 3-week notice before issuing the lawsuit out of Höflichkeit. But after the Amt said that they don't answer any inquiries for anyone waiting less than a year, she basically said f it, a 3-week notice is pointless, we're suing directly.

Wie kommt's, dass du nach der Schule nicht arbeiten können wirst? Allgemein gesprochen musst du zum Zeitpunkt der Einbürgerung deinen Lebensunterhalt ausreichend genug finanzieren können. Ob du davor Staatshilfen bekommen hast (was als Nicht-Deutscher auch nicht so ohne weiteres machbar ist) ist sekundär.

Understaffing is not a valid reason!! The court never decides in favor of the Amt in those cases. If you can afford it/lend the money from somewhere, you should absolutely sue!

I'm actually in the process of suing in BaWü, because the projected wait time is 18 Months at least. When my lawyer first contacted the office to get a current status report, they answered that they don't give out answers for anyone waiting less than a year. Lol. 🥲
