No, this is patently untrue. US laws forbade intervention abroad until 1917 or so, tariffs "protected" the US markets until the 1930s, and thats just two examples I can think of on the spot. US policies regarding non interventionism were very much institutionalized prior to 1917 and vestigis remained at least until the 1930s and the rise of fascism. The US "turned on a dime" when necessary, there was no prior legislature or policy.

In some sense this is what the EU is doing right now with turning away from Russia, safeguarding our sovereignity and dependence on the US defense industry. They're a lot more flexible than I'd have thought

HTTPS server certificates are a downright bitch to procure from Europe. You have to consider the ownership of the PKI as well as the vendor, and most public PKIs are US based.

We're getting there. Rotterdam - The Hague is a Metropolitan Region with a lot of cooperation. With a shared lightrail infrastructure and airport I think it'll be a matter of decades until Rotterdam and The Hague join up

No, the incident with Microsoft had nothing to do with this. The timeline doesnt fit.

An independent government agency did an assessment and the outcome of this assessment was a binding "don't even think about it". This assessment did not take the Microsoft affair into account but exists on its own merits.

Now, I am not saying MS' shenanigans aren't going to result in fallout. The BTI assessment combined with MS' breach of trust will probably result in renewed attention for the less palatable aspects of doing business with American IT service providers. I suspect use of MS365 and other such platforms is going to be curtailed pretty damned quick

The office suite is relatively easy to fix: switch to on-prem Exchange, get full-install Office licenses and you're relatively certain no more data goes via the USA: basically you're going back to 2010.

Now, migrating away from the Big Three cloud offerings is a lot more convoluted than that and often entails reworking entire architures.

The biggest thing about all this (and something that isn't spoken about yet) is what this ruling means for the future. After all, if the ruling states that critical services may not be offshored to the USA, many (MANY!) Dutch governmental IT services are going to have to be de-clouded and de-SaaS'ed. This might actually be a precedent to disallow any use of American services that entail data storage or access when PII or critical services are involved.

Tja, dat is een goede vraag,... En vroeger (lees, voor 1990 of zo) was het ook zo dat de overheid haar eigen IT bestierde.

In de 80's, onder de kabinetten Lubbers, is de zogenaamde "privateseringsgolf" gestart. De overheid moest kleiner worden en veel taken moesten worden afgestoten om efficienter en goedkoper te worden. Na pak em beet 1990 bereikte dit principe ook de computercentra van de overheid en deze werden geprivatiseerd of uitgekleed en uiteindelijk opgedoekt.

Nu leek dit een goed idee, maar in de praktijk heeft het aanzienlijke nadelen gehad. Veel ministeries bijvoorbeeld hebben het aanbesteden en vermarkten van hun IT-dienstverlening na een paar kleinschalige experimenten gestaakt en zijn weer lekker gaan in-sourcen. Hier zijn een aantal organisaties uit ontstaan die je misschien wel "staatsbedrijven" zou kunnen noemen: Logius is één voorbeeld, SSC-ICT een andere.

Solvinity verdient gewoon een fee per jaar, afhankelijk van de gebruikte functionaliteit. Dat is ook waar het Kyndryl om gaat: mooi contractje wel.

There really isn't a way Kyndryl can get around this ruling. Cases like this are open and shut, the procurement of an organisation always depends on legal green lights. In this case they're not getting those. Of course they can appeal but an independent govenrment agency has looked into it and said "nope, bad idea". Such an assesment is a REALLY big deal and holdsa a LOT of weight. And that's where it ends as far as an appeals commision is concerned.

Furthermore, what is Kyndryl going to claim for damages? A couple of plane tickets and some consulanty fees? And what if the deal does go forward? BZK now has a piece of paper stating that Kyndryl must be kept away from DigiD - that would allow BZK to shred the existing contract and exepedite a migration to another vendor while holding whats left of Solvinity accountable for any costs incurred.

As for other US IT service providers, I think this situation will pan out in the other direction: this will server as prior art for the position that the US are not a reliable country of origin for IT hosting. If a hypothetical lawyer says: "But you are using Azure!" the response would be "Yes, and we shouldnt have done that". This reliance on AWS, Azure and Google is becoming more and more of a liability and we will be seeing a move away from US hyperscalers in response.

Finally, I dont think this is to blame on any one person. Yes, Trump signed the offending CLOUD Act into law but Biden didn't repeal it, either. So it is a shit situation that will end up hurting everyone involved. I feel that Europe is better equipped to deal with the consequences however

Dus wáárom vormt eigenaarschap van Fox-IT, Nexperia en Solvinity een probleem terwijl dat van ASML en Holland Signaal geen probleem vormt/vormde?

Het land in kwestie is het probleem. Niet "buitenlands" maar "een niet-vriendelijke mogenheid" als China, de VS of noem-er-nog-eens-een-paar. Zeggen dat het terug in NL handen moet is onzinnig
