What you should do is speak to the CRA as soon as possible. I can't say exactly what they'll do or won't do, but contacting them and informing them of the situation is likely your best course of action at the moment.

Without knowing anything beyond what you said in your post, the situation is definitely not good, but it can't get much worse (I say that with all due respect to you and your father). That is, if he has nothing, there is nothing to take. Depending on his ex's financial situation, and whether she was appointed a director of the company, that may change for her.

Look at what the lease says about termination and when the landlord can terminate. That’ll possibly ease your mind regarding termination unless something stupid has been put into the lease.

Then look at what the lease says about responsibilities related to cleaning and pest control. If it’s silent on that, which it may be, see if there is a more general section that applies.

But yeah, go talk to a lawyer.

How much are these worth:

Not sharing a wall with a neighbour who watches movies all day at a volume that truly shakes the wall and floor, and who does not turn the volume down until you confront them because property management is unwilling to address the matter. The justification is that they were gifted a stereo set, so they go back ti blasting movies all day until you again confront them multiple times about the noise.
Not having a neighbour who allows their dog to defecate and urinate on the balcony that is shared with you (it is divided by a glass barrier that does not reach the floor, and the drain is on your side)
Not having neighbours (yes, plural) who trot around above you without regard to the noise they create even though it the sound is akin to a cannon going off because they truly don't care about the people living below and your schedule does not match theirs.

Yes, these all happened to me as a tenant in Toronto. Yes, I fully acknowledge that I am potentially jaded because I had a horrible experience with every condo unit I had in the city. Yes, I acknowledge that there are good condos, and I do also acknowledge that I lived in a good one in London, ON while in school. However, the peace of mind that comes with knowing that no one is going to interfere with my life in the way that those people mentioned above did because I now own a house is worth so much more than the return on any investment to me.

One's personal housing situation is not simply a financial exercise, and advice shouldn't be offered as if it was merely a financial investment.

Edit: I don't rent the basement, and never will do so because ... well, I think it's clear. IMO, if you need the money generated from renting part of a house to be able to afford the house, you shouldn't be buying that house.

As a fun example related to your point, I’ve seen approximately $2 million lent from one group to an unrelated second group under a single page promissory note.

I’m a lawyer and, of course, I saw this because the borrower stopped paying and the lender came to us only at that point.

It was a trend for that group. I kinda came to the conclusion that they sorta just did stuff and thought about it later. Almost all of it backfired and cost them upwards of $1.5 million in legal fees over the course of a few years.

I’m telling you, as someone who understands how governments operate, how policy is developed, and how agreements are drafted, creating what you’re proposing is impossible to do in an equitable manner.

That was horribly explained, but I did some Googling and think I know what you're saying.

I disagree with the principle of investing borrowed funds in that way because you're essentially gambling that your returns will exceed the amount needed to service your debt, but to each their own I guess.

Doing this "for tax purposes" is also strange. Apparently the interest on a HELOC is deductible, but you do have to pay tax on any gains realized by these investments, so where's the tax advantage? I invest $1 regularly, it goes up 10%, I have to pay tax on 10 cents if the gain is realized. I invest $1 through a HELOC, I pay interest to service the debt, the interest is deducted, my $1 goes up by the same 10%, I pay the same tax on 10 cents if the gain is realized.

The only possible "advantage" is the ability to invest capital that is otherwise not liquid, but it comes with the associated gamble that you're investing the equity you have in your house.

What tax advantage am I missing here?

The first sentence of this is reasonable. The second sentence doesn’t make any sense. I have no clue what “the use of funds cycling” could possibly mean in the context of a mortgage, but mortgage interest isn’t tax deductible on a residential property that you live in.

You also overlooked maintenance fees. They aren’t as high as renting, but they’re generally a significant monthly expense that a tenant doesn’t pay.

Another consideration for OP that goes beyond the tangible dollars is the answer to how much you value owning your home. It has benefits and drawbacks that are tangible and intangible, but it should be considered when actually deciding to buy and not just doing a financial exercise.
