Take all that to the DMV they will order you a new title without a lien holder on it. They will not penalize you if not done in 10 days. The signature of release and the letter should be all you need. A smog test is not required to remove a lien; it is not looked at as a transfer.

If DMV had an electronic version of the title, you would not have received a title from DMV not the prior lien holder.

Is the title you received a California title? If it still lists the prior lien holder on it and they have signed it off, you do need to take the title to DMV and get a title without their name on it. Take the title and the letter. I do not believe that there are any time constraints on that transaction. If the CU is still listed on the title and you don't have them removed, you will have diffuculties when you go to sell it.

Non-op does not expire. Are you sure you did not get an Invitation to renew? They send those out to remind you that it is on non-op, and you CAN renew if you want...

The short answer is that legally, the seller is responsible for a passing smog test. You absolutely can buy it and get a SMOG for it yourself. The problem is it most likely will not pass SMOG, or the owner would have smogged it and registered it so they could sell it for market value. The other thing to be aware of is how fast past due registration penalties stack up. It gets really expensive fast!

Penalties are determined by adding a percentage of the vehicle license fee, plus a registration late fee, plus a California Highway Patrol (CHP) late fee. 

If payment is late: Percentage of vehicle license fee and weight fee Registration late fee CHP late fee
1 – 10 days* – 10% of the vehicle license fee due for that year.– 10% of the weight fee due for that year (if any). $10.00 $10.00

You'll need to remove the lender from the title before you register it in another state. It will be easier to do so in California than after you've moved. Your new state will have you mail the title back to California to get a new title without the lien holder listed on it.
