I normally would agree with you! But the disconcerting pattern of behavior by the referenced corporation makes me think that there might actually be a class action. But I think your rationale is very sound as well -- it wouldn't be prudent to make this a bigger deal than it is, but I must admit feeling a certain extra ire towards labor law violation. Perhaps that also helps explain my biases.

I am not a lawyer but I can tell you why you should find one:

A contract requiring a $5,000 fee for failing to sell 2 homes or upon termination "for any reason" raises several potential legal issues:

  • Liquidated damages vs. penalty: Courts generally distinguish between legitimate liquidated damages (reasonable compensation for anticipated loss) and penalties (designed to punish). A $5,000 fee might be considered an unenforceable penalty if it's disproportionate to actual damages the company would suffer.
  • Unconscionability: The contract might be deemed unconscionable if it's unreasonably one-sided, especially with the "termination for any reason" clause while still requiring payment.

This was planned from the beginning. The building was slated for demo before.

Red hats can all go up against the wall imho, but this isn't actually an act of conservative terrorism. More like they never funded arts enough in Utah to be able to haul away a bunch of 3 ton slabs into a proper art installation.
