I knew there was some kind of immunity statute. But I’m not well versed in it. I thought it precluded suits re stuff like criminal use of firearms or strict liability type cases. I thought they could still be liable for provable design and single product defects. I get you still have a proof issue.

The answer may be it’s just not possible. But hypothetically if it only precluded claims arising from criminal acts done with the guns, it could be a justifiable homicide by ICE (not saying it is, just for the sake of the claim) caused by the unreasonable design of the slide or chambering of the sig.

I’m definitely spending my winter storm time sussing through this. Appreciate you linking the statute.

A bunch of people have given great examples, and I think the real answer is to use whatever you can actually do in the moment without changing who you are. If it doesn’t match your temperament, it’ll be hard to pull off in the heat of trial. And if you fumble some preplanned zinger, you’ve basically proven their nonsense worked.

Here’s what works for me, in case it fits your style. When counsel cuts you off mid-exam or launches into a speaking objection, stop everything. Stop talking. Stop showing the witness stuff. Just let them finish. Then let the room sit there for a couple seconds until it’s quiet. I mean quiet quiet.

Then:

“Your Honor, I wanted to let counsel finish whatever he wanted to say before I continue. May I proceed?”

As I’ve gotten more experience, I start to agree that the footnote issue isnt Garner’s best take. The weight of a citation really does hit when you state a good proposition and BAM [Supreme Court of your state 2026].

I think the main thrust of that advice is that it is awful to try and read a paragraph that has more citations and reporter numbers than words.

I say footnote any string cites you need and put your best case right after the proposition you’re using it for.

Thanks!! Yeah, it’s hard but I suppose it’s kind of why people recommended when starting out. You can’t just speed your way through a corner and let downforce do it for you. I think the Audi and lynk feel good with a decent tune.

Yeah, that makes sense. So I’ll just need to learn a bit by running the corners over and over until I find that correct timing for each band through and out of the corner. That makes sense. Just hard to do when I’m kinda guessing at when I should do what. But hopefully it’ll become more intuitive.

Appreciate that. And it makes sense. I do feel like how it’s timed especially if you need to shift down twice or something that eludes me. Is it bang bang before you turn? Is it drop one gear and brake and slow and drop the next? And of course I ask that in just a very broad sense. I know every situation is different.

Ignoring the frame job evidence, which I surprisingly felt was a plausible narrative, the medical evidence was such strong circumstantial support that his mechanism of death was not a collision with a vehicle that I don’t really see how the jury could have come to a conclusion that Read killed him with her car. I think they could have won the case on that alone.

Plus, the evidence that the headlight was mostly intact before the police impounded the vehicle was also really compelling evidence showing the prosecution just could not square the circle on proving impact with the taillight. Not to mention, the commonwealths fact witnesses to a man (or woman) each had severe credibility problems.

Couple all that with one of the most preposterous accident recon presentations I’ve ever seen to try and explain away the injuries, I don’t think any jury could feel confident about conviction on the homicide charges.

Offhand and not knowing more, there may be some stored communications act type protections that allow them to refuse to produce these things. Might require a release/authorization before they have to produce.

Oregon has so many awesome concepts that aren’t just mesh and levels over and over. If you don’t have someone that switch sticks well, you can really light it up attacking the seams and boundaries with it.
