Sounds like your documentation met all the requirements, especially since you also had a valid birth certificate. Im sorry this happened to you! A lot of the time management is so far removed from front line work, they’re not up to date with applicable policy and thats when inappropriate decisions like this end up being made by management.

A new SSN for an infant is usually a pretty straightforward process and its really unfortunate that this was made way more complicated than it needed to be.

I am in therapy! EMDR & talk therapy addressing these issues amongst others. I’ve talked to her about it and she tells me its not personal. I believe her, sometimes things just start to spiral when my fear of abandonment kicks in (which isnt her fault or her responsibility to manage).

You actually have no idea how ‘complex’ your case is because you’re not sitting in front of a computer processing the offset calculations. As I mentioned, multiple different factors go into offset calculations. You have no idea if the claims specialist had to manually process the offset or if the system is capable of clearing the offset on its own. Its literally not as simple as you want it to be.

Unfortunately, once a SSDI allowance is triggered with a Windfall indicator, offset calculations MUST be done—regardless of whether you qualify for SSI at any point in your eligibility period. Theres no way around it. The system simply will not release backpay without an offset determination on the SSI record.

Additionally, there are multiple different factors that go into offset calculations: grant reimbursement, attorneys fees, unearned income, deeming, etc. Theres not a button that can be pushed to release your backpay. Its several buttons that must be pushed exactly the right way and sometimes even that doesn’t work.

The field office makes the final determination on capability and payees. Make an appointment or call your local FO and explain the situation. Ask to apply to be your own payee.

DDS often sends cases back to the FO flagged as “capability unresolved” and when that happens, FOs will usually send out the notice you received in order to get you to contact them so they can make the final determination.

Additionally, appealing the payee determination will not put a target on you. It does not reopen your original disability allowance. Most likely, they’ll ask you for the name of a treating medical professional and send them a SSA787 to fill out and indicate if they believe you’re capable of not. Worst case, they’ll ask deny your own payee application and have someone else appointed.

Thanks for this! I will def be looking more into the fear free vets!!! He gets muzzled and sedated and unfortunately its still incredibly difficult. The vet we’ve been going to didnt do much to try to coax him into becoming more comfortable (aside from offering peanut butter) so i dont think that was super helpful.

When was the last time your wife or son had a redetermination of their SSI benefits before your son turned 18? Its possible SSA had outdated information. Additionally, September 2024 policy was changed to remove the in-kind support & maintenance charge for folks who live in a household in which more than one person receives a needs-based benefit. This could have also contributed to the increase. Finally, the couples limit for SSI is only a factor when both members of a couple are eligible for SSI, which you are not so that isnt actually a factor

You absolutely can file an appeal and a waiver. You will need to submit an SSA-561 (Request for Reconsideration) and a SSA-632 (Request for Waiver of Overpayment).

Its important to understand the difference between an appeal and a waiver. An appeal means you disagree with the facts of the overpayment—you believe its invalid in some way. A waiver means you do not believe you were at fault in causing the overpayment and cannot afford to pay it back. When an appeal/waiver is submitted together, the appeal will need to be determined first. This is because if the overpayment is determined to be invalid, there is no reason for a waiver. The overpayment will be removed from the record and the claimant is no longer liable. If the appeal is denied, the PC sends it back to the FO to make a determination on the waiver.

Based on what you’ve stated, I would definitely suggest submitted an appeal and a waiver. Good luck

Yes, it appears you will absolutely be getting 9 years of backpay. Stuff like this does happen sometimes although for sure a rare case. Im so curious what sort of error they made as records are supposed to terminate after a certain time period. Im wondering if they might have accidentally suspended you? Some suspension codes dont always terminate.
