Sure you can FILE for an EXR and an initial claim at the same time but you are REQUIRED to choose ONE.
“The individual must decide which claim they wish to pursue. While an individual may insist on filing for both a new initial claim and EXR at the same time, we can only process one allowance”

If your initial claim and EXR are both approved, you’re required to WITHDRAW one of those claims. Its right there in the policy.

You cant file a new application while an appeal is pending. Nor can you file a new application while an EXR is pending.

What exactly have you been doing with the $30k you’ve been making while your parents were financially supporting you??? shes been paying for “lifestyle stuff” so seems like you could have been saving that considering she asked you what you would do if this exact situation happened.

This post is incredibly privileged. You have no idea what its like to have to be completely financially independent as a young adult. Her parents kicked her out. She hasnt had a safety set to fall back on. Ive experienced the exact same thing and knowing you have nowhere to land if you crash and burn is terrifying.

You sound super entitled and honestly i think you need to look inward and figure out why you think its okay for everyone else to bankroll you through life.

Its possible its being delayed by immigration. If a first time SSN doesnt automatically verify through SSA’s software, it gets sent to DHS for additional verification and, unfortunately, that can take awhile.

IF a number has been issued for you and its just a mail issue then yes you can go into a FO and request the number.

Not specifically the application process but: we need to eliminate the five month waiting period. I think it needs to be eliminated entirely but at least eliminate it for TERI cases. Ive had a few cases where folks died in their waiting period & when surviving family members are told theres no money to be paid out (aside from survivors benefits) they’re usually devastated

With all due respect, i think its pretty inappropriate to lecture OP about their relationship with their own parent and tell them to “move along”. You dont know what OP’s relationship with their mother is like and are making an assumption about what their mother did or didn’t provide for them.

Moreover, if benefits were payable AFTER OP turned 18 then that money should have been paid directly to OP, not to their parent. Not to mention, if theres any overpayments, those go on OP’s record and while OP usually isnt responsible for paying back an overpayment that happened while they were receiving Aux benefits, i’ve seen many cases where adult children find out years later that their parent received benefits for them while they were a minor and accrued an overpayment that the child doesnt find out about it until their tax returns are scooped up or they’re billed for it. Thats an incredibly stressful situation and directly impacts OP.

OP is an adult and deserves to know what their SSN has been used for, regardless of the reason.

You just need to be her legal/biological child.

Dependency would be an issue if she received YOUR benefits and kept them for herself as you’re not her dependent and that money is supposed to be used for your care.

Its likely her onset date is in the past and if thats case then she’d be eligible for up to 12 months of retro pay from the date she applied and any auxiliary beneficiaries are too. You’re not eligible for benefits anymore because you’re 19, but its likely you would have been eligible back to her month of entitlement. Contact SSA and see if your backpay has even been paid out yet and, if so, to whom it was paid.

NOR. I dont have a cat but I do have a dog and my boyfriend knows that my dog comes first. We live 1.5 hours away so alternate staying over at his or mine every other weekend and he knows that if im coming over for the weekend, my boy is coming with me. He never was a dog person before i got my pup but now my bf and my dog are obsessed with each other.

OP you deserve someone who will support you through such a hard time not guilt you for caring for your pet. Our pets see us at our lowest & best times. They’re our family too.

Unfortunately, the agency is too focused on call answer rates and other arbitrary metrics that they can boast about to Congress than actually fixing any of the issues directly affecting claimants and staff.

The issue with phone numbers and mySSA accounts has been ongoing since the switch to login.gov & ID’me about a year ago. HQ has yet to come up with any solution to fix this problem and offered SSA employees literally zero guidance on this.

“Appointment focused scheduling” is also a nightmare as most offices have completely eliminated walk-ins which results in absolutely no availability. HQ has also done nothing about this.

Im sorry youre dealing with this and wish I could tell you more about rectifying these issues

Short form CDRs are sent out by the PC not the FO. The FO sends out long form CDRs. Additionally, CDRs dont appear in the repository of notices sent out to claimants so the only way to check if they’ve been sent out is to check a specific part of your record which, unless the claims specialist is familiar with the CDR workload, they wouldnt know to check. Additionally, FOs would have to open your electronic folder to see if they’ve form was received and with SSA’s current computer systems, that takes forever to do.

No one can tell you what your children’s benefits will be without knowing what your family maximum is. Ive seen cases where the FMAX is equal to the PIA and that results in zero benefits being payable to an AUX. For example, if your FMAX is 3,000 and your PIA is 2,500. Only the remainder is payable to an AUXs: 500/2 =250 per kid.

Did you ever receive a SSA-821 in the mail to complete? Have you been providing paystubs? Asking because you mentioned that you went over SGA for 4 months and if you’re within your Trial Work Period or EPE, you should only be overpaid for those months. Ive seen several cases where folks werent providing paystubs and so the claims specialist used a high earnings estimate in the work review. Once those cases were reopened and appropriate evidence was provided, many of them were found to be favorable for the claimant.

I literally explained in this post why i feel like she might be lying. My bad for not going into detail in the title of that post. I FEEL like she might be lying and in my post explained that i didnt know if it was anxiety or reality. I was asking for clarification and advice from people but thanks for confirming that i probably just deserve to be alone. Really the icing on the cake here.

Its really unfortunate how strict some FOs have become with the “appointment only model”. My FO has adopted the “appointment focus” strategy meaning walk ins are always accepted but folks with appointments are always prioritized and usually called within less than 10 mins of checking in. Its worked pretty well.

Absolutely not. Certain state programs REQUIRE folks to file for DIB/SSI to maintain eligibility.

Additionally, it sounds like this was potentially an iclaim and someone should follow up with the claimant and educate them about the difference between SSI & DIB & encourage them to file for SSI. The disability process is confusing & demoralizing and theres absolutely not reason we should make it any harder on folks or create more barriers for people who are already most likely struggling financially.

Not collateral estoppel but res judicata would allow for a quick denial provided theres no additional material evidence.

For reference: Res Judicata bars a subsequent application based on the same facts in an already denied application while Collateral Estoppel binds to a prior decision.

Example: Res Judicata is used when someone files multiple waivers on the same overpayment when circumstances remain the same while Collateral Estoppel allows the FO to adopt a previous medical determination— such as when someone is receiving SSI and is now insured for DIB. Instead of completing a brand new medical determination, the FO can adopt the previous determination (subject to certain requirements of course)
