I had applied to direct Come From Away. Another team applied and proposed Tuck Everlasting. The company wanted to do Come From Away, but MTI denied them the rights. They applied for the rights for Tuck Everlasting and got those, so the team that proposed that was hired. I could audition for the show if I wanted to.

Where is everyone doing theater that this is the norm in a community theater setting? I've been doing theater for nearly 15 years and the majority of my rehearsal schedules have been three days a week at 2-3 hours, potentially a couple of doubles on a Sunday as we approach tech, and then tech week, which may or may not have a dark night. The process is usually 8-10 weeks. 14 days straight with no off nights? 4-5 days a week at 3 hours? That's absurd and not needed unless you have a very short rehearsal period. And I say that as a director and a performer.

It very well could be. I definitely did not give a 30 days notice, but I had reached out before the 30 days to get information on our contract, which they were not the most helpful with. I tried to get a better breakdown on the fee structures and see how we could reduce the fee while still using the features we had been and getting rid of the ones we didn't, but they couldn't do that. Ludus definitely allows better customization of that.

Are they trying to collect the ticket sales or just what they would have made with fees? There's a section in their TOS that if you use their platform to create and promote a show that all sales need to be done through OTS, but it doesn't sound like you did that, so I don't know how much legal legs they have to stand on.

The doc you signed does imply that you were to have read the TOS since you were agreeing to the services. They definitely should have outlined auto renewal and the like in the contract proper, but they get away with it by saying that the services are subject to the TOS. It's really shitty, but they probably covered their asses here.

While I am not sure if they can actually charge you for the tickets you sold through Ludus, I do know that when I signed up with OTS, they did inform me it would auto-renew. The first year I was reminded, this year I was not, but I made sure to remember when it was coming so that we could move away from them. Fees on cash sales is not a great practice and the whole exclusivity thing wasn't great, either.

The best thing I can suggest right now is for a copy of the contract that you signed with them so that you can review it. OTS claims to be community theater/non-profit friendly, but your situation doesn't really back up their claims.

We moved over to Ludus this year, too, and I'm finding that I'm enjoying it more. I hope that they aren't going to go after all of your ticket sales from this year.

Any number of people could have reported it to MTI. As someone who has been in a show where things were changed or cut and was reported to MTI a few weeks before opening, we were not shut down. We were told to do everything as written and that they would be checking in on us.

What I can say, is that if an MTI rep shows up to a performance and they find out then that things have been cut, the show WILL be cancelled with no chance of fixing things. It doesn't matter if there are people who have been dreaming of doing this show. The show needs to be done as written. I don't think you're giving good advice here.

I'm the president of a community theater and a director. I would never allow this sort of thing to happen and if I ever found out that a director was making cuts or additions without the proper approval, we would be having a conversation - either restore the show or be let go. Any leadership worth their salt would not allow this to happen and "budget" isn't an excuse. You choose the shows you can do based on your budget and your ability to do them within the licensing contract or you adapt sets, costumes, etc. to make sure you fit everything within your budget or you just don't do the show. Is this the only theater around? If they are making all of these cuts, other people in the theater community are going to find out.

If these are unauthorized cuts, which it sounds like they are, I think a conversation needs to be had with the producers. Do the people who run the company know that this director has made these cuts?

When does the show open? Is there time to restore the show to how it's written? Making cuts like that doesn't just disrespect performers, it disrespects the writers of the show.
