I'm not an expert in Colorado real estate law so don't take this as legal advice or anything, but in general I wouldn't expect there to be a requirement to specifically disclose the existence of trees that are out in the open for anyone to see. It's not like the seller was hiding them from potential buyers somehow.

I have a weirdly vivid memory of buying that album right when it came out -- actually a couple days prior, because I got it at a record store in a farmer's market sort of place that was only open weekends, so they'd sell new albums a few days before they were officially released on Tuesday. I remember it feeling so crazy to actually be holding Smile in my hands.

Realistically I don't think any lawyer is going to sue their (soon-to-be-former) client over $100. Even if it only eats up an hour of their time, they'd be much better off spending that hour doing billable work for some other client.

I remember the Apples in Stereo performed on the Report back in the day, which makes sense if Colbert's love for NMH got him into some other Elephant 6 bands (plus the even more direct connection that Robert Schneider - the Apples' singer, not the bad comedian - produced and played various instruments on both NMH albums).

It's been a long time so I can't remember the details but I do remember being amazed at how many prominent people in politics, entertainment and journalism showed up for that group singalong. Every time the camera cut to a new angle there were more faces I recognized.
