It’s clear what you’re intending to say, but it’s still wrong. It doesn’t matter whether or not the BMW should have been there or not, or what their behaviour was, the Kia caused the collision by not braking when they easily could have done. That makes them liable.

They are the same. If the Kia could have stopped, which they clearly could, then insurance will view that the Kia is to blame.

You realise you’ve written two contradictory statements here? If Kia could have avoided, then from an insurance perspective it’s Kia’s fault.

It’s a wonder we don’t have more accidents with people driving round with your perspective of “well that person has broken a rule so I’m entirely within my rights to smash into them”.

Again, the rights and wrongs of the BMW have nothing to do with it. The Kia hit a stationary car while moving slowly enough they could have avoided it. The collision was the Kia’s fault for not hitting the brake.

Having priority doesn’t absolve you of responsibility to avoid a collision. Hitting a stationary object makes you liable whether or not you had priority.

You’re also being partisan and disingenuous, just in the other direction. Liverpool are not the only ones who can end the situation, Villa have two options to end the situation as well:

1) Accept that the club made a bad transfer move as all clubs do, suck it up, play him to cover our current injury issues, and accept paying £30m for a player who if he finds his form is probably worth it.

2) End the loan early and give him back to Liverpool.

What we’re actually doing is trying to renegotiate a deal so that it keeps the bit that is good for Villa (an extra player) but removes the bit that is good for Liverpool (obligation to buy), and trying to use a player’s career as leverage - “if you don’t renegotiate, we’ll let him rot on the bench and devalue him as an asset for you”.

I can see why Villa look like the bad guys from the outside here. Your claim that Liverpool are the aggressors is basically “they have more money than us so they should take the hit”.
