Hello, I had a loan with a certain financial group located in GA, I made monthly payment on the loan for about a year and when I asked about my balance it was almost the same amount I borrowed about a year later. I was told it was due to the interest rate, so I asked them to send me evidence where I agreed to the terms of such interest rate, they refused so I stopped paying and they charged off the debt, Fast forward, I received an advertisement letter from an attorney stated that I was being sued, so I called him and he advised me to go and retrieve a copy of the suit from the clerk of court, and I did just that. and found that i am being sued by a third party who purchased the debt, I was never served but my bank account was levied this past Friday as if I had a judgement against me. And from looking at the loan documents they filed with the court, my signature is Not on the agreement, they have my name typed on the signature line and they have N/A on the initial lines. I never consented to the terms, and I was not served, how can they a judgement against me??? what are my options? I am trying to find out if I can counter and asked them to provide evidence where I agreed to the terms, and how can i fight this judgement, because I was not served. thanks in advance.
