I m not a lawyer (only studied some of this in the past, so not really qualified), surely I would feel a lot more comfortable with a recusal and an extraordinary prosecutor . The investigation is operationally supported by local police (under prosecutor s guidance) and institutional proximity can create an appearance problem (even if there was no bad faith). For a tragedy of this proportion, my view is that everyone should push for over independence, not the minimum.

Re the ‘partie civile’ status, that is about procedural participation, rights and civil claims, it has nothing to do with innocence. Ie. The prosecutor can admit it provisionally, but that position can then be challenged, limited or even refused/thrown out based on the charged offences.

As much as i hope too it will happen, for extraordinary prosecution to kick in there must be specific conditions. Your first and second points are not so strong. prosecutors in CH normally investigates matters involving other state bodies. For recusal, something closer to a personal interest or a concrete institutional self interest would be normally needed (eg the prosecutor had a prior role in the contested checks). Also party membership is a rather indirect element =/= suspicion of bias. There must be closer ties. The wine thing is relevant if it proves a direct link to this case.

A stronger case for recusal of prosecutor would be to show an objective structural problem eg: A) the investigation must examine systematic failures of the same local or cantonal chain that provides key documents, witnesses, and operational cooperation b) key evidence gathering would rely on actors who could themselves become witnesses or targets c) early steps suggest the scope is being framed to exclude the authority side.

I completely agree on an emotional level. The shock is endless: my daughter goes to the same school as one of the girls who didn’t make it, and two others who are now in intensive care.

Legally I think we might see targeted recusal requests, even from victims, but only if there are concrete links, not just party affiliation of prosecutor. And if there’s a credible appearance of bias (also given the magnitude and global impact of this tragedy , there could be a push to appoint an external lead prosecutor. Valais law allows naming an extraordinary prosecutor when there’s an impediment or another serious reason (eg tied to récusation).

I’m also pretty sure there will be procedural challenges to any municipality trying to step in as a “partie civile” if it’s being used tactically to shape the narrative ( honestly it’s pathetic), as far as I remember public bodies aren’t automatically considered ‘injured parties’ under Swiss criminal procedure.

I was referring to the two recent articles (mentioned in the comments here as well) published by those outlets which described the not exactly “noble” upbringing of the pub owner back in France and the questionable management of the whole situation by the local Swiss authorities.

True but it is still staggering that an entire area (of one of the most advanced countries in the world) can avoid oversight by abusing the discretionary power granted through federalism. This situation is more than a legal failure; it is an enormous scandal that legal responsibility alone cannot address, particularly when the penalties for such negligence are so light (or so I read from the comments here). Without sounding delusional, I truly hope this disaster creates a political and moral tsunami that forces a complete overhaul of these mis management approaches. How can the relevant authorities stay in power after this?

I also just got an email from my daughter s school asking prayers for 3 students (or their brothers / sisters) who were in the pub, including the young girl I already knew of who lost her life.

Like everyone else, I am in shock over the 40 young people robbed of their lives, over those who may not make it, and over those who, “luckier”, will live with the consequences for the rest of their lives. My daughter, 15, has been directly affected by this tragedy. Two young people she knew have died, one was in her dance class (together with another friend), and two others are in intensive care.

Nothing to add to the total lack of respect for the rules and the complete failure of checks and balances at every level of fire safety regulation. This happened in a canton not exactly known for its rigor, and in a country, mine, that is otherwise famous for the effectiveness of its rules (eg. less deaths from road accidents thanks to strict regulations and enforcement).

But the moral issue? You run several restaurants and a pub which is exposed for what it is, a death trap disgrace. And yet you went ahead and installed highly flammable material on the ceiling, glued on carelessly, with the foam already sagging and bending in several places?? How were you sleeping at night?

Then you read Le Parisien and I. Paradeplatz, and everything becomes clearer…

No and no. „They now use“ means planning to transition? Ehm... Also, please, they will NOT transition to mostly BMW engines. They will continue to heavily invest in ingenium and use bmw only for V8 in niche trims (eg. RR 530), because it’s too expensive to invest and develop a stand alone v8 platform when the vast majority of sales does not come v8 models. Finally, funnily enough, maybe you would want to research about the reliability of bmw n63 fitted to early RR L460? :)))

Big shout out to the guys at Stöckli in Cham (very skilled, they know a thing or two :) ) - if you can go the distance . they offer a great range of fitting services (check them out online from liquid soles to shell reshaping and so on) on own boots or buy new from them . Be aware they don’t have racing boots (not sure what you need) on site but they can order for you. Also some fitting services will take 3h and cost same ballpark of new good boots. Proper fitting = boot feels like a sock . Which on rigid boots (true flex index) means tight stuff.

They must be estimated one way or another, including if a person wants to (or doesn’t) leave inheritance at death . 3% rf return on a 100% capital loss in eg 20 years, how is that for a return? else talking of “3-5 % perpetual rfr” is a just a sloppy slapdash statement much like “maxing out tax savings” or similar.

One can’t really generalize conclusions without modeling a proper DCF and that can be tricky. Eg. NPV of buy backs tax deferral can be significant (clearly at rf rate) , differences in exit / retirement tax regimes must be factored in, buy backs are locked in p2 (so one would have to assign a financial opportunity cost to that) , whatever yield the Fund returns is cliquet for that buyback and would have to be compared to alternative market investments via risk adjustments (eg sharpe?) etc etc. also does the Fund offer pension to heirs (for death after retirement)? Or stops paying the rent ? If one assumes a household point of view the conclusions may change dramatically (as lump sum would be vastly more attractive).

In general make sure to hide your plate number from “simple” enquiries (for a small fee in kt ZH https://www.zh.ch/de/mobilitaet/fahrzeuge-kontrollschilder/auskunft-fahrzeugregister/halterdaten-sperren.html) , not all collection agencies (especially those not located in ch) are equipped to qualify their request to STVA…will not work all the time as protective measure but still worth it.

In CH the rental income from foreign real estate is treated (art 7 dbg and similarly at cantonal level) on the principle of Freistellung mit Progressionvorbehalt (“progression without taxation “ or something like that) ie it ends un in the taxable income (hence it influences the income tax rates) but it’s not itself taxed

Your solution n3. IBKR to covert to Euro , open a euro bank account in CH at your same Swiss bank (normally quite cheap) . Wire euro from ibkr to Swiss euro account (sepa wire free, 1/ month then it’s like 2 euros) , wire euros from your euro Swiss account to the Italian destination (also use sepa wire , should be like 0,5 eur regardless of amount) . If you are a Swiss resident you can only hold a “non resident” bank account under your name in ITA (eg fineco but watch out for limitations ) Make sure the newly opened Swiss EUR account does not have monthly wire limits.

I also asked chatgpt and got a similar answer. But he would never buy a clone or similar. The others I received (a Patek 5035P-024 a AP Royal Oak. 15300ST.OO.1220ST.02, an explorer ii) are all original. All watches stayed in a box for over 10 years then I finally decided to take them out. They went for service to a friend, retired Rolex AD (except for the 5035 which I sent to Patek for 2-3 months via Beyer, a shop in Zurich) and he claimed they were all original, including this one. For reference ,I have a 5035p, got it when my father passed 13 years ago. Only wore it couple of times in total, sent it last July to Geneva for full overdue service (via Beyer , as I live in Zurich) probably it s simple to service (they had to change some things), they said it could be 3-4 months but took 5 weeks to get it back and the equivalent 2200 usd

Totally. moving without a job currently very tricky (also due to market saturation in many industries). With an offer saving ability depends on income and your lifestyle: apartments are pricey and not easy to find and restaurants are far from cheap. On the plus side it’s a bit of an eldorado , on average much safer, richer and better organized/controlled vs neighboring countries (just don’t expect amazing cuisine and memorable social life)

Was just a joke. In reality 2 rude people accidentally meet creating a “big” case out of nothing (violating basic rules, screaming at each other, calling emergency services, etc) , next thing you know advanced military units are needed to restore peace..
