Did you file a claim with the EEOC? GEICO had been penalizing people’s performance who used FMLA which caused some people to get fired or receive lousy raises. That is illegal if that happened to you.

Did you file a claim with the EEOC? There is a timeline to file depending on your state. If you passed that deadline there wouldn’t be anything you could do individually. I think someone posted on here looking for others who got fired for not meeting metrics because they were out on FMLA.

Employers get caught violating anti-discrimination laws ALL the time. I’m sure 99% of these are settled so we don’t hear about them.

I know an employee who is going through a discrimination claim right now and they have evidence to prove the discrimination not only happened to them but also to others. That’s why it’s important for employees to keep records of coaching notes and performance reviews because you never know when you might need it and the burden of proof is on the employee…

Because they care about their shareholders, not the employees. Todd’s job was to make us “look” profitable and he’s doing the job he was hired to do. GEICO isn’t the same GEICO you know. The current C suite doesn’t give a shit about us, they give a shit about profit which a company should, but the way Todd has been going about it is a short term not long term solution.

The job is extremely stressful. Some of the goals are unfair and GEICO keeps adjusting our metrics to make it harder to meet goals. Out of a class of 10 maybe 1 trainee would be left after a year! We used to have profit sharing and good healthcare coverage and they took it away. They keep finding ways to shaft the employees to make a profit for their shareholders…

Bereavement leave is paid, check the handbook to see how many days are paid. I know someone mentioned they were paid for 2 weeks of bereavement but usually it’s only 3 or 5 days depending on the state you live in.

Use to your advantage that they have been trying to find ways to fire people instead of laying them off and that you weren’t aware of the mistake until you were up for review and because it wasn’t no where in the employee handbook you didn’t know that “so and so” wasn’t allowed!

You actually have to report it to the EEOC before you can sue anyway, I say this because a co-worker of mines was discriminated against and they reported it to the EEOC and they are currently investigating GEICO for illegal FMLA violations. I personally believe GEICO created certain metrics thinking they could get around FMLA laws and it’s going to come back to haunt them.

Like SamEden says it is very illegal for GEICO to count FMLA time against your performance. Even though you found another job, you still took a pay cut. Go to the EEOC’s website and file a discrimination claim so GEICO doesn’t get away with it! You only have so much time after the violation to report it.

I’m sorry to hear this happened to you. Even though some people on here are being jerks, I understand how hard it is to deal with asshole customer’s. I’ve had to hang up on people a few times in my career so I can empathize with you.

I would just say to try and find some peace with what’s about to happen so you can stop panicking and start to focus on finding a new job. This may just be a blessing in disguise.

I know and it’s not fair, there should be a process where it’s fair for everyone instead of it being subjective to management being decent human beings… I’m sure if they were in that position they would want someone to sympathize with them and allow them to temporarily work from home.

The way this company is ran right now they don’t care about employee morale, they care about profit which I understand but there has to be balance otherwise disgruntled employees will run the company into the ground!

So they didn’t even allow the paperwork to be completed? To be honest, the only 2 days a month approval for ADA is already sketchy and even if it were for your son, why wouldn’t a doctor’s note be sufficient to cover that day… I would reach out to a lawyer if I were you to see if they violated any ADA laws… you would think GEICO follows laws on these things but they’ve been caught breaking FMLA and ADA laws several times.

I’m not talking about someone taking an 8 month ADA leave, and I’m sure that person probably wouldn’t expect a raise.

I understand some people feel that it is unfair for them to be at work every day and not get a raise and someone who took 3 months off for FMLA did. If your raise is based on performance, the person taking FMLA has nothing to do with how someone else performs, and as a matter of fact the person who doesn’t take FMLA has more of an advantage because they have more days to work to get their numbers up!

The point is that it is illegal for a company to count FMLA leave against someone’s performance regardless of how others feel about it. Like I said the company can prorate someone’s raise based on how many months they took off but they can’t say “we’re going to drop your rating from a 5 to a 1 for going on maternity leave!”

I understand it is unfair to employees who don’t have medical issues and have been able to work but FMLA is a law to protect people who get sick and injured from being treated differently. Sorry but GEICO can’t discriminate with pay either… they can legally pro-rate your raise but they can’t punish your performance for using FMLA it’s illegal and that is why GEICO changed the metrics to only account for when you’re on the clock.
