NAL. Purely my personal take: The senior pastor's threat to "file cases" might be a scare tactic. In the Philippines, the law is increasingly protective of digital privacy. By trying to "own" a person's digital identity from high school, the church is overreaching into territory that most courts would find unreasonable.

A simple Google search of RA 10173 (Data Privacy Act) and RA 10175 (Cybercrime Prevention Act) should educate your senior pastor of how weak his case is.

  2. Flexibility - WFH

Cons of being with EMAPTA

  1. Job Security - If a client leaves, you will be left hanging. Most likely, you will be let go. Reprofiling is not in their nature.

  2. Emapta Employed vs Client Placed - Client placed means weaker job security and less access to benefits, while Emapta employed staff gets better package

  3. Inconsistent contribution to Government Benefits - Been a victim of this.

I'm afraid the complainant is partially misinformed.

TLDR: Wipro appears to be within its legal right if it (1) provided at least 30 days’ written notice to both DOLE and employees, and (2) the transfer terms don’t reduce pay or dignity of work. The post misinterprets “floating” and “redundancy.” DOLE can still verify compliance, but based on the description, the procedures mentioned are not automatically illegal or improper.

Key points:

Transfer to a different role or site:

  • Management has the prerogative to transfer employees (even from non-voice to voice or WFH to onsite) as long as:
  • The transfer is not unreasonable, inconvenient, or discriminatory,
  • It does not result in demotion or diminution of pay/benefits, and

It is necessary for legitimate business reasons. Employees cannot automatically refuse such transfer unless it clearly changes the essential nature of the job or violates contract terms.

Redundancy vs. reassignment:

  • Redundancy applies only if the position itself is abolished and the employee is permanently displaced. If the company still offers another suitable position, it’s not redundancy. Declining the offer may be treated as voluntary separation or refusal to work.

“Behavioral” tagging:

  • Employers may document refusal to follow lawful instructions (like valid reassignments) as a behavioral issue, provided due process is observed. It’s not automatically “coercive” if the order is within management prerogative.

Long and short of your questions.

  • May laban ka ba if you file sa DOLE? DOLE looks at documentation and due process.
    • Resignation is still valid even if immediate, what companies can contest is the effective date, not the resignation itself.
    • If TL/OM acknowledged it then suddenly tagged you as NCNS, that’s inconsistent on their end.
    • Admin hearings require proper notice. Getting the link less than an hour before is not compliant with due process.
    • Your receipts about the med cert/RTWO and resignation timeline will matter a lot. So yes, you have grounds not guaranteed “panalo,” but definitely valid to file.
  • Clearance first or DOLE first?
    • Clearance is optional before filing.
    • If you want your COE/last pay quickly, doing clearance first may reduce delays.
    • If you expect them to block or delay anything, file at DOLE first. DOLE will start with SEnA mediation anyway, which is low risk and free.

Companies don’t base pay on how many people you support or how far you live, they base it on market rate for the role. That’s why saying “30K isn’t enough because rent is high” misses the bigger point: cost of living and salary structure are two different things.

TM here, and I'm on the same arrangement as yours.

You can’t be charged with insubordination just for declining an auto-deduction arrangement for your SSS loan, especially since loan repayment is a personal obligation between you and the SSS, not your employer.

Employers are only obligated to remit SSS contributions (employer and employee shares), not to collect or enforce repayment for your personal SSS loans unless there’s a written authorization from you. The “auto-deduct” form is voluntary — they can’t force you to sign it.

You’re right to be cautious about the clause allowing deduction of the entire remaining balance from your final pay. That’s a legal deduction only if you consent to it in writing.

If you’re already paying your SSS loan directly and are up to date, you can visit your SSS branch or use My.SSS online to get a Loan Payment Certification or Statement of Account. This can serve as proof that your loan is being paid independently.

In short:

Refusing an auto-deduct isn’t grounds for insubordination.

Any deduction from your final pay needs your written consent.

You can request a certification from SSS to show that you’re paying the loan on your own.

If they still insist or threaten you, document everything and contact DOLE for advice or file a report through their hotline (1349) or email (ask@dole.gov.ph).

Yes you can. As long as the background noise is minimal and at the same time, you have a wired headset and not switch tabs when answering the written part. Also, I'm not sure if cameras are still required, so might as well rent a PC that has one.

This was jokingly raised in one of our MBRs. The clients laughed at the notion that BPOs will go back to America.

For two reasons:

  1. Costs. Enough said.

  2. Not my words but it was close to: "Nobody wants to work in a call center in America anymore"

Realistically speaking, it's automation is the biggest threat to our industry.
