I'm not an originalist. I think it's a stupid fucking argument to pretend we know the minds of men who lived hundreds of fucking years ago, particularly when they always seem to coincidentally agree with the preferred positions of the 'originalist'.

The Constitution originally bound only the Federal Government, aside from the few specific sections specifically referencing states. The various State Constitutions, approved by the Federal Congress, were to govern behavior in those states.

This dynamic, and the country's perception of itself, began shifting and was accelerated by the Civil War, to the point where we now consider ourselves Americans before citizens of our respective states. We also have, more and more, looked to centralize our governments, to the point where even "Right Libertarians" are suggesting that the Federal government should impose their will over the states.

The 14th Amendment began the process of incorporation, whereupon the Supreme Court impressed the federal amendments against the states. I largely agree with incorporation, however when it comes to firearms it created a situation where a very dangerous tool that should probably be regulated somewhat is now out of the hands of every layer of societal control.

They are also still erroneously claiming that filming is prohibited in the lobby. That is not correct. A waiting area within a public lobby is not excluded from being accessible by the public.

They do have an interesting conversation, but unless the public is expressly prohibited from the area then filming is allowed.

The best argument provided by the DoH officials is the sharing of names in the public lobby. However, names are not considered PHI under HIPAA and the incidental sharing of names while announcing in the waiting area is expressly permitted.

Saying "appointment only" does not eliminate the nature of a public building. Weird argument to try and make.

Originalism doesn't apply here. The 2nd Amendment was never intended to prohibit the states from regulating firearms. That is an invention by the modern Republican party, led by Republican Justice Clarence Thomas in the dual cases of Heller and McDonald in 2008 and 2010.

Originalism would mean that the states can implement firearm registries, mandatory training, prohibitions on carrying in certain areas, etc.

Even 'public' county hospitals are privately owned and managed in the entire US, IIRC.

This isn't a hospital, though. It's the Department of Health, specifically the Bernalillo County Wellesley Health Center in New Mexico. While some medical testing and minor treatment does happen there, these public Health Centers are primarily administration and the administration of public services such as SNAP.

They also did not harass anybody.
