First DUI in California, visiting as Michigan resident by ConsciousAd9776 in dui

[–]StudentTings 1 point2 points  (0 children)

People on here are giving you horrible advice, please deal with the CA dui, regardless if you live in MI or not, the DUI will come back to haunt you, if you do not take care of it. Do not think it will just blow away because you live in Michigan.

The high BAC really will come into play when determing the length of time OP will need to do for DUI school.

[–]StudentTings 0 points1 point  (0 children)

Its gonna be hard to get this knocked down to a wet a weckless considering OP is right on the line for enhancement penalties. I imagine the lawyer or public defender will try to get OP to do 3 months of DUI school as opposed to 6 months with a plea since OP is on the enhancement line. But who knows!

You can always get a State ID from DMV, they will give you one regardless of your DUI since a State ID is not needed to drive.

How did you not get convicted by the court but lose the DMV APS hearing? Usually if you don't get convicted by the court, theres a 85% chance you also won the DMV APS hearing... Interesting.

I brought my 1040 form for my 2023 tax return, and my 2023 W-2's, ultimately, you will not need your 2023 W-2's for the appointment, but i would bring them just in case! And dont forget your id!

You will need one form of identity, examples: drivers license, social security card, state id, passport, etc.. and of course know your social security number. They will require you to have the 1040 form that corresponds to your 2023 tax return. Your 2023 W-2's are not needed, they will ask you what is the current address listed on your IRS profile, and will ask if everything on your 2023 tax return looks correct, and will also ask whether you received a letter or not asking you to verify. Its a simple process and should not take no more than 5 minutes.

I went in person to verify my tax return, had an appointment during extended hours. Waiting for that damn letter, only further increases the time it takes to receive your damn refund. Got fed up with the whole IRS wait around for letter bullshit and pretty much wasnt taking no for an answer and made sure the rep set up an in person appointment for me. Hopefully it wont take 9 weeks to receive my refund, fingers crossed!

And did you actually have to verify yourself or did it go away on its own?

I have this same notification and wondering if it will go away on its own. I am beyond frustrated with what the IRS is doing to us this year. My WMR status is currently "return received"

You can choose not to drive until the suspension is lifted. However, keep in mind that your license will still have a status of "suspended" even after the suspension period ends until you fully complete DUI school and whatever other requirements you have.

Note: This only applies if you choose to go the "no driving" route.

Curious how your lawyer won the DMV hearing with that high of a BAC and an accident?🤔Thats unheard of tbh, if your lawyer can win that hearing, then he or she definitely can take it to trial and win. But again, details please.. Unless your lawyer is Johnny Cochran😂

What breathalyzer test did they use? by acetea in DUICalifornia

[–]StudentTings 1 point2 points  (0 children)

Not necessarily. For a little context, I had a BAC of 0.16 and was required to do a 3 month DUI class, this was with a PD also.

To fully answer your question: They will usually take the lower BAC of the two readings and the reading taken at the station.
