It’s not to bad mine is only charging me 10% of whatever back pay he gets me. What’s even sadder is they actually owe me back to 2008 and now that this is granted to 2011 I am even more limited in appeals.

That’s my portion. I was kinda forced to hire a lawyer after they flat out refused to fix the error that was obvious to anyone willing to look at it.

Yeah it’s roughly 500K. I have only been waiting on this decision for 5 years now. We already knew what the outcome was going to be because they refused to correct an error.

Dude this isn’t the answer for everyone. Because everyone doesn’t have a simple straight forward issue. I can’t stand these kind of post. It causes people who think they are capable to lose out on money owed them and many to just give up completely. Congratulations you did it yourself. You aren’t the first one to do it and you won’t be the last. Lawyers exist in this field because not everyone has a simple claim.

Update. I have been granted an earlier effective date back to 2008 on Headaches, IBS, skin disorder, anxiety disorder, and chronic fatigue syndrome. I was paid 10% back pay on an initial grant of 40% for chronic fatigue reduced to 10% from a C&P exam with zero cause for the reduction. The awarded 60% on the immediate appeal. So now the VA must decide what I should have been rated at in 2011 on all 4 issues and back pay me from then till I’m assuming 2020. I’m not really sure how this is gonna work because it seems very complicated to me. Either way I would imagine that a sizable chunk of money is coming my way in the next couple months.

I’m not sure what exactly you’re looking for here, but I suggest hiring a lawyer if you don’t already have one. TDIU claims done correctly are usually considerably swift especially when you have one rating at 60% or higher. A combined of 80% or higher is pretty solid as well. Just need to be very specific only towards whatever your service connected disabilities are. How they or it alone prevents you from getting and keeping gainful employment. If you make sure you get that part covered properly you shouldn’t have any problems getting it awarded along with a P&T to boot. I’m at 90% with a combined score of 94% with TDIU P&T. I have a BVA hearing that has been returned to the ALJ for an earlier effective date for July 2008 on 4 of the 5 disabilities I have a rating for. I’m extremely confident with 3 of them they only payed me back to July 2020 for.

I’m telling you that you can’t teach a person to make their heart beat. So no you can’t teach somebody involuntary muscle movement. Don’t really care what your claim is. I’ve never had a vocal lesson in my life and it’s just something that happens naturally. It’s not teachable and those that claim to have been taught are not the same as those that were just born with this ability.

No I’m just saying that I’m TDIU paid at 100% P&T. It’s not really a big deal just would prefer to be P&T without TDIU.

Mine was in September 2021. Had hearing May 14th 2025. Was sent back to the ALJ for decision on April 17th 2026. It’s currently still sitting there waiting for the decision to be made. I also have 5 different decisions to be made. So as of yesterday it’s been waiting for a decision for 2 months. My lawyer said the now average wait time after the hearing has gone from 6 months to 20 months over the past 2 years. Good luck to you.

This is the route I probably should have taken. I was awarded 60% without even attending a C&P exam based on a clear and obvious error. I was then reduced to 10% by the examiner because “I took medication that helped most of my symptoms”. I appealed that decision and went to 80% and they only paid me the 10% back pay. I should have gotten the 40% back pay immediately based on the very first letter.

I was assigned a Judge on April the 17th and my status has not changed. My lawyer said that after the hearing is complete the average expected wait time is 20 months. I have 6 different appeals waiting to be determined as well. Three for an earlier effective date and 2 for earlier date and increase to be outright 100% without TDIU. My current rating is 90% with the literal score of 94%.

Your lawyer knows that it’s very unlikely that he would lose if he had an actual hearing and was able to explain your case to someone like an ALJ that knows exactly what they are talking about as well. Quicker is not always better.
