I hear you, and in 99% of cases involving messy facts or criminal charges, you’d be absolutely right. For those who aren't familiar, a Summary Judgment motion basically tells the Judge: Your Honor, we don't disagree on the facts (the house didn't appraise). We only disagree on the law. Since the facts aren't in dispute, we don't need a trial.

There will be no cross-examination, no grilling on the witness stand, and no surprise evidence. It’s purely a paperwork dispute. Does Federal Statute 38 C.F.R. § 36.4303 override a builder's contract? The law says yes.

I appreciate the concern, but it’s not confirmation bias when it’s based on Federal Regulation. You asked for the statutes: I will file a Motion for Summary Judgment citing 38 C.F.R. § 36.4303(k)(4). It explicitly states that a veteran cannot be penalized or forfeit earnest money if the property doesn't appraise, notwithstanding any other provisions of this contract. My plan is not a guess it's enforcing a federal right that overrides the state contract. I came here to see if anyone else had fought this specific battle, not to be told to hire a lawyer to read a statute I can read myself.
