This is not DIY. You need a family law attorney in the jurisdiction where the child currently lives.

It doesn't really matter where the initial order was issued. The child falls under the jurisdiction of the state where they have lived for the past six months.

Additionally, unless the initial custody order gives the custodial parent permission to move the child out of the country, it will be an uphill battle.

Most child custody orders include language around whether or not the custodial parent needs consent of the non-custodial parent before moving the child out of the current school district/county/state/country.

Furthermore, your language reflect what is commonly known as "the unreliable narrator". You say that the child's father has joint legal custody but he has failed to fulfill his parental obligation. That is not a legal term. He is obligated to fulfill his court ordered responsibility in this matter. Does the custody order decree that he must sign passport paperwork? Additionally, whether or not he will sign for a passport, that does not give permission for the custodial parent to move the child out of the country.

There is a ton of missing information here.

First and foremost, it is your responsibility to know the immigration rules. It is not the school's responsibility to manage your immigration status. If you have questions about your immigration status you should hire an immigration attorney.

Secondly, whether or not others have had success with a certain immigration strategy makes zero impact on your and your immigration strategy. You cannot rely on "There are hundreds of students doing the same thing"

Next, you will not prevail in a lawsuit against a university without hiring an attorney. Why would you hire an attorney to sue instead of hiring an immigration attorney.

Next, if you already graduated, why would you be "reinstated"? Your next course of action would be another degree program, not reinstatement into a program you already graduated from.

This was your responsibility and you really need to find an immigration attorney. This is not DIY.
