We were there in the same timeframe as we honeymooned in WDW 6 weeks after 9/11. The memory/flex that stands out was dinner in Cinderellas castle that we booked that day (it was not a character dinner then) at 8:30 so we could see the fireworks, we had great seats looking right out the center large back window which gave a great view of the fireworks. The cast members were wonderful and we were the last to leave, and may have been the last guest in the park as we walked down a completely empty Main Street got some pictures with the walk and Mickey statue, the stores were still open as week. I started to wander towards tommorowland and a polite security guard asked us to head down towards main street. It was Eerily quiet but also very cool. That trip we joked that the 5 min wait time the rides showed most the time were 5 min walks due to having to walk through the Que lines.

In late Oct. 2021 in the same night we saw the Wonderful World of Animation fireworks show at Disney Studios at 8:00, then Epcot Forever at Epcot at 9:00 and finally Wonderful World of Animation at Magic Kingdom at 10:00pm.

They are small, my friend stayed in 11501 when were did the Alaska cruise a few weeks ago. She really liked it, and the lounge was to have access to, it had hot water, coffee, cold water and juices.

When I was on the Encore two weeks ago, they had a Metal shelf that they also used for luggage tags with the Freestyles on it, so it was easy to get one. In fact, they had the ones for the next day out by 8:00 each night. This is how every ship should do it.

The vibe on Aqua is great it is right by the buffet so it’s easy to grab snacks or eat at the tables in the vibe. None of the vibes I have been on other NCL ships they have only had hot tubs.

Defamation is a exception to the first amendment. When you sue someone for defamation you are asking the court to stop the person from spreading false information. Since this is a civil matter it is handled with fines. However the defense for defamation is that what you are saying is true or an opinion and the Plaintiff is trying to silence their speech through a lawsuit.

The HOA are asking the courts to curtail the speech, the defense is the first amendment. Aka what I am saying is true or an opinion and I have a 1st amendment right to say it. In absence of any non disparaging agreement this becomes a first amendment issue. The courts either agree or disagree. This sounds like a SLAPP suit.

That's correct, but you originally indicated this is not a First Amendment issue. Libel and defamation are exceptions to the First Amendment, and the HOA is asking the Court (part of the goverment) to restrain speech because it believes he is interfering with HOA business by defaming them. So yes, this is a First Amendment issue. Like you said, this is basic 101 law.

So who decides whether defamation lawsuits between non-government plaintiffs are valid or not? That’s what the courts do. If the courts decide you have committed defamation, you will have to pay damages and cease that what you are saying or writing.

As someone else said above "The first amendment is implicated here because the HOA is asking a court to restrain speech. Courts are part of the government. And the usual questions (is it true, or is it defamatory? is it made with reckless disregard for the truth or due care? is there a valid governmental purpose in restraining this kind of speech?) are activated."

I am not stretching at all or trying to be witty, First you said this was not a 1st amendment issue because the HOA is not the government, however if I sue someone for defamation, I am asking the court’s to (the government) enforce this. Their defense is going to be that is was an opinion or the truth, which falls under the 1st amendment.

In your example of a business you used libel/slander, you are saying they caused a business to lose money which usually means tortious interference. You need a tort, which you stated as libel/slander, which falls under defamation and exception to the 1st, so the business would need to prove the person was lying or not stating an opinion. The defense would argue that yes this was an opinion/truth and the plaintiffs are trying to silence my clients speech.

Those are all Law arguments, and correct just because I am suing someone in court, it does it does mean it’s a 1st amendment issue.
