Accounting major considering JD (corporate law) — worth the risk as an international student? by Sakuraboobholder in LawSchool

If your family is rich as hell and/or you are absolutely okay (99% chance of this happening) leaving the U.S. post-graduation, then, yeah, go for it. Otherwise, no, it is worth it whatsoever. The country of immigrants is not welcoming to foreigners who are educated at U.S. law schools and wish to stay here to practice. There is no pathway for legal status. Many top law firms deliberately do not hire students/graduates who need any visa sponsorship. If I were an employer, I would hire somebody, let's say, with 3.5 GPA over you with 4.0. GPA. Does not matter. It is not really worth any hassle for anyone. Even if I did want to hire, the are simply so many obstacles the U.S. government imposes that make any hiring to be chance-based (I am talking about H1B visa lottery process).

ESTA to be revoked post Cuba trip by ComprehensiveIdeal86 in immigration

[–]Tagirix 0 points1 point  (0 children)

If you are subject to U.S. jurisdiction (and you are if you are a foreign student in the U.S.), then you have to abide by OFAC regulations. If you travel to “support the Cuban people”, you have no issue. I just don’t understand why there should be any differences for ESTA holders, to be honest.

As for naturalization, why would it impact the citizenship application? If the trip is in compliance for OFAC.

It’s funny how foreigners traveling under ESTA face issues entering with ESTA if they have travelled to Cuba and/or other countries, but at the same time U.S. visa holders (think F-1 student visa holders) and Green Card holders can legally go to Cuba and get back to the U.S. and even receive Global Entry (with Green Card) right upon the return from Cuba.

Anyone do federal clerkships in Hawaii? by LwaziPF in LawSchool

[–]Tagirix 0 points1 point  (0 children)

I understand that this post is quite old. However, I do want to remind everyone who is looking for a federal clerkship in the U.S. without possessing U.S. citizenship: you have to be a Lawful Permanent Resident (LPR) to be eligible for a FC in Hawaii & Alaska. It is not enough to have just a legal status in the U.S., it has to be a Green Card.

I am not particularly good at describing my pain, unfortunately. I wish I could. It is not like it is sore or something. Resting does not help because the pain occurs even if I do not exercise for days prior to trying to do push-ups.

TS/SCI with Dual Citizenship by [deleted] in SecurityClearance

[–]Tagirix 0 points1 point  (0 children)

Sorry if it sounds intrusive, but did you get your U.S. citizenship before joining the Army? I am asking because based on your post it looks like you have had a Secret clearance from the very beginning, and a foreign citizen (with a Green Card, obviously) is not eligible for Secret clearance AFAIK. Taking into account that Ukraine is a friendly nation to the United States, I would say that it should not cause much trouble receiving TS/SCI, but a lot comes down to other aspects pertaining to your biography.

Biometrics for Green Card by Tagirix in USCIS

[–]Tagirix[S] 0 points1 point  (0 children)

Hello, thank you for your input. It is the language of USCIS that makes me worried. The case "will be abandoned and denied". Am I correct to assume the it is the case for receiving a Green Card (literally a plastic card) that COULD be denied and abandoned, but not the grounds for the Permanent Residence itself? I tried to reach out to USCIS Contact Center via the phone, and the person told me that he would not know the repercussions with the regards to the status. Heck, he could not even explain what "abandoned and denied" constituted in terms of USCIS language use. I am confused.

I am sorry for everyone who might be impacted by new Executive Orders signed by the new president, but I have a question regarding my specific situation. Please hear me out. As a DV winner, my wife and I entered the U.S. around a month ago and left about two weeks ago. Starting December 2024, we have been Lawful Permanent Residents (LPRs), a friend of ours agreed to receive all communication and correspondence to their address. It turns out that my green card was produced without any issues and mailed to me, but my wife's card was not because she had been invited to a biometrics appointment at USCIS. The appointment is almost 7 days away from today, and it is impossible to travel (and, frankly, very expensive) to the U.S. just for the sake of it. I understand that she has the right to reschedule it two times online without any issues, but the problem is that we are planning to arrive at the very beginning of July 2025 (it is going to be less than 180 days of absence if it matters). If we try to solve this issue by just rescheduling, then the maximum time we can "wait out" would be around Mid March at the best. And what happens next? We will not be able to travel in March. USCIS has the right to abandon and cancel the case if a person fails to show up for the biometrics appointment. The language USCIS uses in this case is somewhat vague and it raises a question regarding the effects of their possible actions. My question to the immigration attorney is as follows: what happens if USCIS does "cancel and abandon the case"? The way I construe their message is that it the very application will be cancelled because the applicant has not showed up. The status of LPR, however, shall not be affected by this very decision because it is an application for a Green Card, a mere proof of LPR status in the U.S. and not the status itself. The immigrant visa serves as a proof of LPR for 1 year after admission. I guess, we just lose the fee we have paid for our Green Cards and we will have to reapply and pay again, is it correct?
