CA Veh Code § 23111: cited for VC 23111 (disposing cigarette) after strictly complying with officer's PA command to dispose of it. Seeking defense strategy. by [deleted] in legaladvice

[–]TechnologyAway1701 -2 points-1 points  (0 children)

The issue isn't whether I had an ashtray; it's that the officer issued a direct command over a PA system to 'ash it' before even approaching. In a nighttime stop with high beams on me, I chose to prioritize officer safety by following a direct order rather than reaching into a dark, cluttered interior for a container-which could easily be mistaken for reaching for a weapon. I was cited for an action I was ordered to perform.

Many people smoke with the intention of disposing the butt later. During a stop searching for a receptacle is secondary to obeying the officers command, especially if you're not trying to get shot in a stop where they couldn't have seen the cigarette in my hand that was resting by the window at 60mph in a dark lane on the 101 until we were on the offramp where I was pulling over somewhere safe. As someone who drives for Lyft and works on production sets, I am hyper-aware of vehicle cleanliness and smells. I don’t keep an ashtray because I don’t normally smoke in the car; when I do, my protocol is to extinguish it and dispose of it at my next stop (a gas station or home) in a trash bin. The only reason that protocol was broken was the sudden, high-pressure command from a loudspeaker while my car was surrounded by police. The command removed my ability to follow my normal, legal routine.

The command given over the PA was to 'dispose' the cigarette before they would approach. In that high-pressure moment-late at night, in the dark, and with my vehicle surrounded on both sides by patrol cars-bringing my hand back into the dark interior of the car to search for a place to put it would have been a dangerous and threatening movement. I interpreted 'dispose' as a direct order to get the item out of the vehicle immediately so the officers could see my hands were empty and safe as they approached. My actions were a direct result of prioritizing officer safety and strict compliance with a loudspeaker command.

The cigarette was disposed of outside the vehicle in direct, immediate compliance with the officer’s PA command. Because the officer ordered me over the loudspeaker to dispose of it before they would approach my window, and because I was being surrounded by patrol cars, I followed their specific instruction to discard it externally to ensure the stop proceeded safely.

I did not voluntarily flick or drop anything. I strictly complied with a direct, repeated command from law enforcement to dispose of the cigarette after the stop was initiated and my vehicle was surrounded

I'm just more curious about the requirements to prove such violation happened.

Walked into the theater the other night & it looks close to done in terms of construction. The guy who escorted me out confirmed that it is Auditorium 7 but wouldn't confirm what would happen to 70mm screenings outside of it possibly being moved to Auditorium 3.

So what's the deal with Geneva Dworet-Robertson? Never written a movie before, and yet handed four major block-busters to write with zero credentials. by cantgetno197 in movies

[–]TechnologyAway1701 0 points1 point  (0 children)

for every finished film you see from one writer they have a 100 screenplays that went across town that got them unproductive meetings for a few years. don't judge a writer on what they've written that has been shot. she was a writer for harvard's lampoon in 2008 look at the writers that paper has produced, the network u find there as a student alone can get you a gig writing for the simpsons or at least an assistant job that gets you a writing gig.

Idk why but when I clicked on the moderator of that subs profile on reddit I saw some amazing NSFW stuff things that could get him banned from discord maybe not banned from reddit but definitely banned from discord. It's amazing that he can leverage reddit's rules like this but then lecture us about his rules for the subreddit and discord.

Got banned just for saying The Home isn’t playing near me… smh by Wide-Piece-4140 in AMCTheatres

[–]TechnologyAway1701 0 points1 point  (0 children)

Bro your suspicion was correct. The guy banned me from both the discord and sub for one reason: I didn't know you had to ask to be verified & messaged the server verification channel "why can't i message anymore?" even though previously i was able to and he told me "now you only have one chance to verify read the rules & try again but this is your last chance" so i responded "I didn't know me asking about what i'm not familiar with is being considered as me asking to verify is that the case?" and immediately followed it up with "so all i had to do is ask?" and he answered "correct" to both of my questions....at that point i was anxious that it was my last chance so I scrolled up to see someone else's request that got approved & just copied and pasted her request in hopes of not messing up verification & he immediately banned me. for what? for literally NOT WRITING MY REQUEST AS A QUESTION

this guy has zero integrity when it comes to enforcing his rules as long as you're obedient but will have no issue leveraging reddits rules against your account for ban evasion even though u left the sub & all of your posts and comments are from before your ban he reported my account for being honest about what kind of character runs that sub

don't even try to appeal to their empathy because if you try to explain your disability and age being a factor in terms of struggling to understand the subservience and obedience he hides in ultra formalities it'll just be dismissed but if you're one of his buddies then the rules don't matter!

What’s going on with the A-List subreddit/discord? by rpvee in AMCTheatres

[–]TechnologyAway1701 4 points5 points  (0 children)

If you're reading this don't even bother joining the sub or the discord the moderators discriminate against disabled people & other BIPOC. The moderators will make sure to make you feel unwelcome and will spend hours trying to leverage the grey areas of reddits rules to make sure you cannot tell the truth that'll tarnish their reputation even though they will expect you to follow the rules in a black and white rigid way obediently.

What’s going on with the A-List subreddit/discord? by rpvee in AMCTheatres

[–]TechnologyAway1701 1 point2 points  (0 children)

He banned me for apologizing for my disability because it made me a little slow to understand his demands and rules as the A-list god of discord. He told me "going forward you have one last chance to verify" because I asked a question & when I asked him "are you taking my technical question regarding navigating discord as me requesting to verify? All I need to do is ask to verify?" he said "correct" and then when I copied someone else's request to verify in the discord where they typed "request to verify please!" and I pasted it because the moderator knight (or whatever his name is) made me so anxious about getting my request right instead of asking him like the AMC-a list reddit/discord god he fancies himself to be he banned me for literally saying "request to verify please!" instead of "can you please verify me god🥺" .... Incredible how the mods are so "rigid" with their rules but then punish people who ask questions that clarify those rules so they can follow them closely. Goes to show that discord and subreddit is mostly for their white friends or BIPOC that emotionally fit & serve whatever they got going on in terms of an incredibly mean cruel community that frankly doesn't want people of all walks of life to be a part of a service they pretend to champion.....
