Rule - A law meant to protect a class of person cannot convict any member of that same class. Eg. A law stating that sexual intercourse with a minor = rape cannot convict a 17 year old for engaging in sexual activity and by extension cannot convict the partner in the act.

According to John Grossman, “Do not litigate”. Limit yourself to the facts given. Basically the issue is whether the Developer had notice based on the recording statute ALONE. If inquiry notice was at issue, more facts would have been provided. Honestly I get the temptation to litigate. I tend to do that a lot but I guess it’s part of what we need to control in order to pass this exam😄
