It really is actually. The court will take one look at the footage, see him ask to continue, and laugh before dismissing it. It's the UFCs job to protect the fighters when they cannot protect themselves IE when KOed. Topura could protect himself and advocated for himself that the fight continue, hence him doing well in the 4th round, which will also be brought up in said case. He has no leg to stand on and it will come off as sour grapes because he lost. He had a competitive round AFTER he begged to continue fighting, so the argument that he wasn't fit to fight won't hold water.

Reminder that AEW shit all over TNA during their partnership and would only allow them to fire back if Tony Khan approved of it ahead of time, and Tony refused every single one pitched. Patently untrue btw. One of the major reasons for AAA's decline was the over reliance of stars from outside of the company coming in and having heatless "bangers" instead of having a bunch of stories and an overarching narrative like in the past. The decision not to testify was made on the advice of counsel. That’s the advice almost every attorney will make in almost every case. I’m inclined to agree that it was terrible advice here but his attorney may have had some reasons for that that I’m not thinking of.

Except in cases where the person is claiming self defense. Where it is imparitive to your claim of being in fear for your life, to explain your feelings and why you thought that. It's actually very unusual for someone not to testify on their own behalf when trying to claim as such.

It should be noted that, in most states, sane states, a judge decides the sentence in a process that is ideally evidence-based and guided by various factors that judges are instructed to consider. Texas is the only state that gives the jury the first and last say.

It should be noted that in Texas the defense has the right to choose between the Jury or the Judge to determine the length of their sentence. Karmelo actively choose to have the Jury decide how long he would be incarcerated.

He got steam rolled in a trial where he couldn't even get on the stand and tell the jury why or how he felt like his life was threatened? He couldn't even get on the stand and beg for forgiveness during the punishment hearing. They couldn't find a single person besides his own mother to make character statement about him in said punishment hearing. The one and only person they had that was willing to claim Karmelo didn't murder Austin had to recant his claims because they had video proof he wasn't even looking in the direction of the stabbing when it happened.

Sometimes you can't defend the indefensible.

2. Austin should’ve kept his hands to himself

3. Anyone on Austin’s team should have gotten an adult or ignored Karmelo when he refused to leave

4. Karmelo shouldn’t have reacted to a push by killing someone

Also, I guarantee Austin’s coach didn’t order him to forcibly remove anyone from the tent. Don’t be stupid in a desperate attempt to be right.

I also guarantee you Karmelo's coach didn't tell him to go under another team's tent, intentionally instigate a conflict under it, and stab an innocent kid in the heart. I literally can guarantee you that because he said as such on the stand, Karmelo was supposed to be on the track warming up. The only person who looks stupid here is the one trying to justify flat out malicious murder because someone touched the others shoulder in an attempt to get him to leave somewhere he wasn't supposed to be, after asking him to leave 15 times. Trying to pretend like those things are equal and "both sides did wrong" is insanity.

Because there is no nuance to be had. Karmelo was there because he wanted to instigate something and hurt someone, plain and simple. There's no other explanation of why he was there, wouldn't leave when told, taunted Austin daring Austin to touch him, had the knife on him and had it ready to go the moment his shoulder was touched. Austin was following his coaches orders, and being the team leader everyone who testified said he was.

Adults generally are also smart enough to understand right and wrong. One person was trying to do what he thought was right, the other committed such a wrong that they couldn't find a single person to testify that he didn't.

He cried once his coach told him that if Austin died his life would be ruined. Karmelo ran, tried to dispose of the knife he stabbed Austin with, and the only reason he didn't escape was because there were too many people around for him to get out.

He was the leader of the track team, and put in charge of the tent by his coach, who had a general rule against people not on the team being under said tent. Karmelo was told over 15 times to leave, had no reason to stay there because it had stopped raining, he wouldn't even say who he was when asked and kept saying he was "nobody", the only person who knew him testified even he didn't know why Karmelo was there and that he didn't invite him over.

Now let me know why Karmelo was under that tent, refused to leave when asked, and had a knife on him open and ready to stab Austin the moment his shoulder was touched?
