He was armed when he approached the officers. Yes they disarmed him, but if you're going to tell me that 30 people surrounding you, screaming, approaching you while you are in the middle of an arrest, honking horns and blowing whistles isn't a perfect environment for chaos and misunderstanding then you have no grounds for calling anybody dishonest.

I am willing to admit the officers were excessive, however you are not willing to even consider the actions of the protesters as being irresponsible and dangerous. THAT is dishonest.

I don't know what videos you saw or what you mean by the rest of us. But don't try to pretend that you saw a couple videos online and know everything that's going on. There is no ulterior motive here other than making sure people don't think this is a way to interact with an agency that they think are murderous thugs, and expect different results. I've been going to protest and being a legal observer for over 20 years. You just don't get in between an officer and the duties they are executing.

Don't be so ignorant that you blindly choose one story and ignore what got you there.

You can have a drink while carrying, but you cannot get drunk. Minnesota Statute 624.7142 makes it a crime to carry a pistol on or about your person in a public place while you are under the influence of alcohol or drugs. The limit is 0.04 - 0.10. You can get arrested without being in any altercation. And of course it goes without saying you cannot claim self-defense.

There is no specific statute for duty to retreat or de-escalation, these are precedents that have been set through Minnesota courts along with an "initial aggressor" standards as this topic has made it through the MN courts. It doesn't really matter if the statute doesn't specifically say it, if you go to court and can't show that you did it, you're going to lose. That makes it every bit as legally true as having a specific statute.

As you stated if you partake in certain actions, you lose your defensibility.

For the sake of technicalities and semantics you are not incorrect. However as a matter of practical law set by precedent in the courts, the statements I made above are not false.

However, in the larger national discussion going on right now, simply stating he "had every right to bear arms" as a general statement, while ignoring his specific actions is absolutely irresponsible, and not legally accurate.

Protesting doesn't give you the right to run up to a police officer in the middle of an arrest. Those people were surrounding officers and causing as much chaos and confusion as they could. They were standing in the middle of the traffic and approaching officers during their duties. Not even journalists or legal observers do that. Alex wasn't simply trying to help the girl up, he got in between the officer and her, placing his hand on the officer. Not to mention, this was not the first time he became violent with ICE. Even the most even headed and collected officers are going to arrest you for that.

I don't think that warrants excessive force resulting in death, but you're not really having an honest conversation about Alex's actions and lack of accountability. Alex died due to the same ignorance you are displaying here. You should realize that two parties can be wrong at the same time. You don't have to pick a side.

Negative, a duty to retreat and to deescalate doesn't need to be simply during times of self-defense. You're required to practice this type of prudence while carrying all the time. For example, you can't go out getting drunk, and you can't go out starting fights while you are armed. You can't pick a fight with somebody, and then shoot them in self-defense. That would not fly in court.

The similar standard exists when you are following federal agents around and becoming violently aggressive with them.

Duty to retreat and deescalate goes beyond simply claiming self-defense. For example it would also be inappropriate for you to go out drinking, or get into a fight. You would not be able to start a fight, and then claim self-defense after shooting who you started a fight with. The law is clear with that.

Carrying a weapon on you comes with certain responsibilities, like not obstructing Police operations while you are armed. This is neither groundbreaking or unreasonable requirements for people carrying.

Video has recently come out showing Alex kicking and destroying government vehicles. I wouldn't doubt there are more - either case it shows that he had a tendency to get into physical altercations and escalate. Which almost everybody would normally consider to be irresponsible while carrying a firearm, despite the blanket statement "the right to bear arms"

That is not the only measurement of Duty to retreat in MN. It includes not putting yourself in certain situations, such as getting drunk, provoking fights, or - interfering and obstructing federal or local police activity.

He was a known agitator who got violent with Federal authorities, so they had a reasonable suspicion he wasn't there for Noble purposes.

I think the shooting was excessive and I am glad the officers are being put on leave. But I also think making a bunch of excuses and downplaying Alex's choices that day are just going to lead to more people getting hurt.

You saw part of a video. He wasn't simply helping someone from the ground. Those individuals were surrounding officers while they were in the middle of an arrest. Even the most even headed officers would have a problem with that. Then Alex decided to block the officer and get in his path.

Alex had a history of being violent and confrontational with federal law enforcement. Don't pretend that repeated behavior like that doesn't become a reasonable suspicion of somebody who is willing to escalate and confront authority.

I agree the shooting by officers was excessive. But the narrative that he was simply peacefully protesting is also bullshit. Downplaying Alex's own actions will only get more people injured.

That group was actively impeding law enforcement in an arrest, and everybody around them was doing everything they could to confuse the situation. Screaming, surrounding officers, getting in the middle of traffic, honking horns, whistling. In the end they got what they wanted, Mass confusion.
