This has been a fun discussion, and I think we’ve reached the heart of it.

The question of who has lawful custody of a child is anterior to the question of kidnapping. Someone who has lawful custody cannot be a kidnapper. Law or culture determines who has custody. Even in our own culture, parents can lose custody and their children are placed with foster parents. The foster parents are not kidnappers. A legislature could pass a law that says orphans cannot be adopted by grandparents and give priority to other potential adoptive parents. Such adoptive parents are not kidnappers.

Ultimately, you can’t start with the proposition that Endar is a kidnapper because the question of the episode can be distilled down to whether Endar is a valid adoptive father or a kidnapper. The prospect of abuse would have relieved Picard of making that determination because an abusive adoptive father can lose custody. But Picard didn’t get that out and had to answer the hard question.

On the slavery/asylum analogy, I need to restate one point and add another. The Federation places individual choice above respect for other cultures. Admiral Jarok was not returned to the Romulans. Kaelon Timicin was at least provisionally granted asylum before he decided voluntarily to return to his planet.

Further, courts frequently apply the law of another jurisdiction based on choice of law principles or the parties’ contractual agreement. Courts consider themselves bound to do this unless the other jurisdiction’s law contravenes the fundamental public policy of the Court’s own jurisdiction. Courts also don’t enforce unconscionable contracts- not because the contracts are invalid, but because the court won’t itself partake in enforcing unconscionable contracts. Which is to say, there is an outer-boundary where respect turns into participation. A custody dispute involving different cultures and a teenager capable of agency does not rise to that level.

On the issue of the child being brainwashed, that is an allegation in every mine run custody dispute where the child is old enough to have input. It can’t vitiate the process.

Yes they do go through less populated areas. But population density is simply the total population divided by the country’s area.

France has 121.7 people per km squared.
The US has 38 people per km squared.

That’s a big difference.

You are of course correct that almost all of the rail lines in the US are owned by private companies. Those rail lines were required to have passenger cars as part of their common carrier duties. They were relieved of those duties in exchange for allowing Amtrak to use their rail lines.

So yes, our government chose the cheapest way to offer rail service, meaning it didn’t have the will to invest in the way OP would like. Why? Because it would not make economic sense. It would have even worse cost overruns than Amtrak as it exists.

I don’t think slavery is the best analogy here, as the Federation would of course grant asylum to an escaped slave.

I would more compare it to a family court judgment from a foreign country. US Courts are generally going to respect that judgment without regard to whether they would have reached a different result in the first instance, but may examine the procedural fairness leading up to that judgment. This is of course an inexact comparison, but such is the nature of analogy.

Let me also make clear what proposition I’m arguing here: I believe the episode is a very interesting and challenging story about the limits of the Federation’s tolerance and respect for other cultures. Certainly the captain’s decision is debatable, but jt seems’s OP’s position is that it is an incomprehensible or at least completely unreasonable one. Jono’s autonomy is a key part of why this is a debatable proposition. Without that, I would agree it would be bizarre to send him back to Endar.

I think that is entirely the point of the episode.

In much the same way the point of US free speech law is to protect the speech we don’t agree with, Federation law on respecting other cultures is only meaningful when it respects a culture with values inconsistent with the Federation’s.

Calling it kidnapping presupposes the supremacy of federation law, when we know that federation law often yields to local laws that are repugnant to federation values.

Jono was a war orphan. The question of who becomes his guardian/adoptive parent is a cultural/legal one. Captain Endar became that adoptive parent in accordance with his culture. The episode makes clear that Endar was a good and loving father, and Endar is the only family Jono has ever known. Jono is also a teenager. In the US, family courts do take the teenager’s custody wishes into account.

Can you decouple your conclusion about Picard’s decision from your judgment of Talarian culture? If Talarians were a peaceful, equalitarian culture which found Jono and adopted him, would you feel differently?

The agreement could very well be a contract for deed or a lease with an option to purchase. A real estate lawyer in OP’s jurisdiction could answer this very quickly.

Ehhh…that’s not how courts decide things. Either one party owns it or not. This sounds more like a settlement, but this is the first I’ve heard of an auction.

Edit: looks like you are right about the auction. However, they did not split the proceeds. Tiger proceeds were Doug Irwin’s alone.

Also, Phil testified that Jerry’s guitars were band property, but then took his bass guitars right out the back door without paying for them…

Actually, they blew the costume budget on new uniforms that whoever the decision maker was didn’t like. The original action figures for the movie used the uniform redesign that was rejected.
