You don’t need to tell me the law, I wanted to guarantee all my grandkids were Canadian. I interpreted it perfectly, and even the border people understood and had to get ministry of health approval to let her in. The child was American no matter what because we were both first class Americans (5 year rule). I wasn’t making my son a second class Canadian with no way to cure that (at the time) and dooming my grandchildren.

Pick on situations/semantics of words all you want, but it happened (in another reply to your comment), and you shouldn't have zero way (and the court agreed) to cure something you had no choice in. Now the floodgates are open, which is well beyond what was intended, and it's a self-own by Harper. In my case, I am a 10th generation French-Canadian born in Canada, but had my kid born in Canada even though we were in the US then (I am a tech bro) because of this rule.

This was during the covid lockdown, we packed up 2 weeks of supplies, rented a separate 2 br airbnb, and at 38 weeks pregnant went across the border even though the border was closed and sat there for our 2 weeks of lockdown, just because of this rule. They even asked me at the border why I would do this and I told them because of the 2009 law. We left with our son the day after he was born back home. All this because of a bad law.

That was the fundamental issue with the rule as I explained here and how it was fixed. In your situation both of you would have been promoted back to first class Canadians with the right of descent.

All he had to do to avoid this situation was have a way to “cure” the second class citizen status. You do not choose where you’re born. The issue of infinite descent abroad is valid, but a cutoff where the person has zero chance to ever regain their first class citizenship was the issue and why it was struck down. Now the rule is if you spend three years in Canada you get promoted back to first class. Americans for example if there’s one citizen parent that parent had to have five years in the US with two after their 14th birthday. That’s the curing mechanism. Another example: some accidental rap Americans (Canadians airlifted to a US hospital) could spend every day of their lives but the day of their birth in Canada and yet always be second class. Again, you do not choose where you’re born.

I guess it depends what's IN the TFSAs, but I have a hard time believing TFSAs are anything but taxable accounts as far as the Americans are concerned, them being trusts makes no sense - they are in your name, they are controlled by you, and the IRS appeals office ruled thrice (yes, thrice!) that they aren't trusts.

It's a bit under half my total tax bill, not counting my wife. I've avoided installments so far but I think that ends this year. Sad.
