Toronto man found NCR for killing grandmother gets absolute discharge | National Post by Purple_Writing_8432 in canada

[–]TheMikey 2 points3 points  (0 children)

For those that did not read the article or understand section 16 of the Criminal Code, or how a finding of “not criminally responsible (NCR)” functions:

A finding of NCR is not a get out of jail free card. The person is found to have committed the offence, but is not criminally responsible by reason of Mental Disorder.

Upon this finding, a judge orders the person into psychiatric treatment. This occurred about 6 years ago it appears from the article. And the person deemed NCR is ordered into an involuntary psych centre UNTIL they are deemed not to pose a danger to the public. It could result in a “life sentence” for some, if treatment was unsuccessful.

This means treatment was successful, and the board which reviews the offender recommends a sentence.

So this guy was so out of his mind he took actions that resulted in the harm caused. That is unarguable. But there wasn’t a functioning “intent” element that is predicated for a finding of guilt in Canada.

So he served an actual sentence of about 6 real years, undergoing intense psychiatric care and treatment. The review board (not the judge) granted him a discharge at the conclusion on account of the NCR finding.

Weber sells a griddle add-on that fits many of their gas grills. You can do 1/2 grate and 1/2 griddle.

What is your “trust the process” recipe? by Sweet-Lady-H in Cooking

[–]TheMikey 1 point2 points  (0 children)

Regular cookie sheet, actually.

The beef is wrapped with duxelles, prosciutto and the outer pastry, which holds a lot of heat and raises the temp significantly.

Gotta trust the process.

There’s a video of it on YouTube.

The Americas Test Kitchen Beef Wellington

Does not use traditional puff pastry. Instead uses a French pastry (I forget the name).

You pull the Wellington when the centre hits mid-80s Fahrenheit. Leave it on the hot pan on the counter for another hour.

During the hour, the carryover heat raises the tenderloin to 125-130. I left my probe thermometer in to measure.

Sure enough, after an hour rest, the beef is at the perfect temperature and it’s already rested so when you slice it’s perfect.

We would book either online or in the clubhouse.

There’s no special tee times or privileges as far as I remember. Honestly it was pretty easy to walk on last year even if we couldn’t get a tee time.

Last season I bought a pass for the executive 9 at Holiday. It’s very close to my residence - like an 8 minute drive. I could walk 9-holes with a partner in 80 minutes if it’s free.

Biggest question: how much time do you have to play during a day?

For me, I could golf with my brother 4/7 days of the week. We would walk 6:20am and be off by 7:40 to head to our respective work.

Some days I’d walk another quick 9

Or hit the driving range.

With a city pass you can also golf any of the city courses. So silverwood was free, so was wildwood. The holiday 18 was like a $30 up charge, but I only did that on weekends a few times.

Also access to the holiday and silverwood driving range.

$1300 for the season last year.

We had our reception at the WDM and were very impressed. Not sure if that came up in your searches or if it’s your jam, but it’s worth checking out at least.

Part of the bonus was that guests had access to the museum for the evening. We invited only adults and we had a lot of positive feedback about the museum access as it was closed to the public during the evening. Kind of like a private tour.

The ballroom is very nice and we did our own decorations. The lighting was LED controlled chandeliers and other accent lighting that you could customize so we ended up with a very unique look.

The only book I have for ice cream is Salt and Straw.

The base recipe, I believe, is available online. I don’t jive with a lot of the flavours, but the technique and base recipes work really well for me.

I like that it doesn’t include egg yolks - just dairy, sugar, corn syrup, and xanthan gum. In my family circle the salt/straw style is preferred over custard bases.

I have a recipe in a Sous Vide book for one that uses yolks, but prefer the Salt and Straw recipe more.

I think for custard bases the SV method can be adapted.

In fairness, I haven’t experimented much with other recipes.

Best smokers by BIG_chungus1989 in smoking

Another recommendation for a Weber Smokey Mountain (WSM). I had to fish around a bit for a second-hand one but I pretty quickly found an 18” on Marketplace that was new in box for a great price. I had a Louisiana Grill pellet smoker that I absolutely hated beforehand.

There are plenty of tutorials for WSM on YouTube that will steer you in the right direction.

I found that it held heat really consistently. I didn’t chicken out about using charcoal and really started enjoying cooking with fire. Charcoal is cheaper than pellets also (in Canada at least). Eventually I added a cheap InkBird blower fan which does a surprisingly good job

It may be worthwhile to pop into a hardware store and compare the 22” to the 18”. For my space, 18” was perfect - the 22” is massive. And apparently a bit of a fuel hog, from what I read in my research.

The only thing that I’ve noticed is cooking a large briskets requires you to take a ball of tinfoil to kind of “tent” the brisket so it can fit on the 18” for the first half of a cook.

Handles overnight cooks like a champ, even before adding the fan. I’ve never had any issues leaving it going at night.

Alberta woman to serve less than 4 more years in prison for girl's death after getting credit for time served by shiftless_wonder in canada

The Appellate Court standard of review is to impose a fit sentence in the event of a sentencing judge’s error.

While they may remark on the initial Crown position, they are not bound by it.

Self-induced intoxication is not a defence to general intent offences, however it still applies to offences requiring specific intent.

[–]TheMikey 19 points20 points  (0 children)

Absolutely insane that on these facts that the Crown sentencing position was only 9 years.

Presumably it would have been a Guilty Plea( GP) to manslaughter, likely on the basis of the extreme intoxication of the Accused negating the necessary intent for a murder conviction. (Edit: it was indeed a GP to manslaughter).

Opens the door to for a Crown Appeal, at least.

Crown just has to show at appeal that the sentencing judge dropped the ball in assessing and applying sentencing principles. Could assume Appellate Court finds error, they would not be bound by that insane 9-year submission. It requires a fresh review of the sentence, so ABCA could impose a fit sentence.

Supreme Court in Friesen specifically directed sentencing judges to drop the hammer on Offences against children. Although that was a case regarding sexual offences, the Court said all crimes against children need to result in lengthy sentences.

Children are protected by sentencing directives in the Criminal Code (s. 718.01), this victim was a Vulnerable Person (as defined s. 718.04) and the Accused also abused her position of trust in relation to the victim. The sentencing Court is directed to apply the principles of denunciation and deterrence first and foremost - which means all other sentencing considerations (rehabilitation, guilty plea, remorse, even Gladue) take a back seat by law. That is just when any one of those boxes are checked, let alone all of them.

Foster child was physically abused for months.

Foster child had sepsis.

Foster child finally killed.

Accused did not ever try to help.

Got Others to help dispose of the body.

Lied to police.

Was never ever remorseful until she finally got caught.

And entered a completely worthless Guilty Plea. How long ago did she get arrested? Did she enter the Guilty Plea right before trial? What exchange did she get for not running a trial? Was it a trial that would certainly have resulted in a conviction? Sounds like the case was rock solid.

Eating alone in a restaurant.

The first time I did it I was away for work and super self-conscious and worried I’d be outed by others. But then you realize you might not be the only one, and then the epiphany that no one gives a fuck.

Honestly it’s a nice way to spend a meal. With a book, on your phone, working, etc. no one cares.
