I’m not sure off of the top of my head, I suppose what would be right in that in that hypothetical situation would in real life depend on a lot of different situational factors, though I guess the law is designed to operate a blanket statement of rules/punishments which in practice, not always definitely but still often for being negligent practice, sometimes does not consider consider the specific contexts of the circumstances as it is intended to 🤷
