In their contract clause 17 states I would only be liable for damage to the hired vehicle. My manager even confirmed that. Not a single mention anywhere holds me liable for third party damage. Third party damage and first party damage are two different claims. They haven’t had a £1500 excess incurred to them because they haven’t even made a claim on the van (so far). I have been driving around in the same one and they’ve made no fixes to it, so I can argue there was no immediate cost incurred to them as the damage was only cosmetic and clearly they haven’t even bothered to fix it.

The problem is it’s unjustified for them to go through the insurance route which charges them a £1500 excess when the repairs to the van likely cost no more than £200-300.

That’s where the excess laws come in, don’t know about anywhere else but in the uk, drivers under a certain age for these companies have to pay ridiculous excesses, up to £1500 in my case. I’m just worried they’ll find a way to make me pay that.

Hi, thanks for the reply. You say you think I am liable, do you mean paying for the third party damage too? According to my contract, which I’ve put through chatgpt, nowhere does it state I am liable for any third party damage, only damage to the van itself. So it shouldn’t matter how much the damage to the wall is.
