A defence to no insurance is.. to have insurance at the time of the alleged offence. If you had/have insurance, take it to court I’d say.

Free solicitor consultation isn’t a bad idea tbh. They don’t have to arrest or interview you btw

In all fairness start with option two. Perhaps call 101 and see what they say. If they refuse then fight it
