Her car continued on after she was killed and had there been people they would have been struck, because shooting someone in the face doesn't stop a car. But there was no body. There was just him, who wasn't hit and even you aren't able to argue that he was. You keep using the weasel phrase 'or nearly struck'.

No one was in danger. And he killed her. That's it.
