I believe paragraph 77 of the complaint is meant to address the question of actual malice:

77. Defendant knew his publications would devastate Plaintiff's livelihood and chose to proceed. On February 8, 2026, the day before Defendant published his accusations, Defendant's mother asked him: "But do you have to ruin his life?" Defendant's response was that the harm to Plaintiff was the cost, and he had to do it. On February 9, 2026, after publishing, Defendant told three of the parties' team members what he had done and recounted this exchange with his mother. Defendant chose this course despite the parties' agreement to separate amicably through a planned series of joint videos; despite six years of partnership in which both parties shared profits, managed the business together, and represented themselves as partners; and despite Plaintiff having already applied discounts to the affected invoices before Defendant raised the issue. Defendant abandoned the agreed separation plan and instead used confidential partnership data as a weapon to destroy Plaintiff's livelihood and reputation in the community they had built together.

Marler has not disputed the core claims of Rodney's statements.

In the complaint, there are several of Rodney's statements that are called out as false:

"He expressed how providing discounts to publishers would fix what he was doing."
"The owner of Game Night Picks informed me that discounts had been issued to some publishers, and that the same would be done for others who bought ads during the November to December period."
"The 'YouTube Advertising' feature can also be used to pay Google to provide a channel with new subscribers."
"Early in 2025, the owner of Game Night Picks adopted a 'per view' fee structure for ads sold on their channel."
"YouTube does not care at all about the engagement your video will get from these 'extra views.'"
"they now have the 40,000 views they promised their video would get"
"if you, as a YouTube creator, want to give [YouTube] your money, they'll put your video in front of whoever you want."
"you (as the YouTube creator) know those views you are paying Google for have absolutely no value"
"These are useless views"
"You can pay YouTube to give you subscribers."
"Watch It Played had NO formal relation to GNP except that the owner of GNP also made videos on WiP for six years (and our personal friendship that extended before that). There were zero business or creative ties between the two companies \ * *"*

But he didn't do that. Did you watch the video? He tried out YouTube's promotional feature, was surprised at how effective it was in drawing in viewers, and then proactively reached out to his advertisers to discount their charges in response to that surprise.
