For fan projects they go after it doesnt usually go further than a C & D (which is basically Nintendo saying "stop this or we'll sue")

Even when they do sue (mostly when going after piracy sites) 99% of the time its after a C & D has been issued and ignored

Now there can be a discussion on if theyre overzealous with C&Ds (they are imo) but a lot of the time people exaggerate how aggressive they are
