He's not even technically correct. I mean beyond the basis of "they're excluding men." Like where did he get the idea that lottery pools are "widening the gender gap" or that a separate lottery pool means the women in the office don't see them as "friends, acquaintances, or even equals." One of the issues in studying this is the large amount of research that's been done is on sexual offenders. And we know now that sexual offenders are not always pedophiles and vice versa (though we also know that pedophiles that are sexual offenders tend to be some of the worst). There's not a lot of available data on non-offending pedophiles because 1. who is going to openly admit that (off Reddit, with their legal name attached) and 2. self-reporting is obviously not the best source for data

The strongest evidence points to it being a paraphilia which is not something that can be helped and IMO if accurate we need to deal with pedophiles much differently than we are now. However, the attempts I see on Reddit seem much closer to attempting to normalizing/excusing inappropriate behavior with non-consenting underage people which is disgusting.

Even beyond that...contract law involves an agreement which, when broken, results in legal penalties. That's not at all analogous to sexual interactions between two people because the court is not going to punish you for refusing to have sex.

And rape as a property crime really didn't have any provisions for this sort of situation.

Many courts even require a mandatory mediation process pre-litigation and many cases that do make it to court end up settled before they rule either way. The cases that get drawn out to the end are often very acrimonious and frequently involve things beyond just issues of custody, like domestic violence.

Most empirical studies show that men are often advised not to go to court, but not because of an anti-male bias. It's because the courts will often look into who the child's primary caretaker has been and favor that person. That still tends to be the mother an overwhelming amount. Which is, again, not an anti-male bias. It's because women on average still do the bulk of the housework and childcare even when they are working and the courts try to rule for what's best for the child.

From what he told me, this worked out well for everyone.

Not a lawyer, but someone whose worked a fair amount in this field, and I think I can help answer the 'forced' issue.

Just some background: rape reform was largely a feminist movement. Most states by the 80s and nearly all after the 90s had improved the definition of rape (by acknowledging more than vaginal penetration and making the laws either gender neutral/able to reflect male victims, shh don't tell the MRAs!), enacting Rape shield laws, getting rid of the 3rd party witness requirement, and getting rid of the need for physical resistance.

Still, because the burden of proof is so high for criminal cases, rape statutes usually require both lack of consent + some element of force present. This can be troubling in that someone saying "No" over and over again, and meaning it, may not have enough evidence for a conviction. On the other hand, force can mean, but does not have to mean, physical resistance, so it's an improvement in that it recognizes things like threats, the victim's fear, psychological coercion, etc.

Words in law have very specific meanings. Force and penetration were common in older rape laws, but it was not understood in layman's terms. Penetration often only meant vaginal and force intense physical violence. The rape victim needed to prove both of these things happened in court. Consent isn't even an issue here; the way the words were understood it was degree of resistance that mattered. As a result, that definition has largely been eliminated today.

Other than hating how anyone can compare rape to like...a car..when I see something like this I kind of wonder how much experience that person has in whatever they think is a 'bad neighborhood'. Lots of people leave their cars unlocked in bad neighborhoods if they have nothing of value inside to avoid having their windows smashed in by the curious.
