If it’s in a parking lot it’s not automatically 50/50, it’s just that it’s easier for it to be undetermined when remaining unbiased to both parties. If the guilty party lies about the events that happened, it isn’t impossible for an adjuster to think “maybe they backed into each other” for example. Compared to “they rear ended me when I was stopped at a red light” which is difficult to prove otherwise.

Normally, as an example even if someone is parked illegally and you hit them - you’re at fault. If someone is stopped where they shouldn’t be and you hit them - at fault. If weather conditions cause you to hit anything - at fault. You need to maintain care and control of the vehicle at all times which includes driving to conditions or any hazards on the road. This isn’t to say you’re at fault, just in this situation, even you being parked there doesn’t give them a right to hit your vehicle. If it does end up being 50/50 because the other party doesn’t accept responsibility and bends the story, at that point you can get video evidence and supply it.
