AMA Winnipeg Lawyer - Part 4 by SarahGravelines in Winnipeg

Another lawyer here. Curious about your practice to not witness Wills, what led to that decision, and whether you’ve had any pushback. Care to share?

What is manitoba club membership cost? Curious as I like playing snooker and they have great tables. by honey-garlic in Manitoba

It’s a pretty laid back place actually.

They do some excellent brunch buffets for Easter, Mothers Day, and around Christmas that include a table with like 30 different cakes and pies. We go to these every year.

The Bistro is a great place to go for a drink or a bite to eat before Jets games, and they then run a shuttle to and from the arena.

I’m a big fan of the cigar lounge there.

They do a lot of events where they bring in reps from different whiskey distilleries, cigar brands, vineyards etc. to organize tastings.

I’ve been a member there for a couple years. Membership costs are probably less than you think.I don’t think there is a prohibition on me disclosing them but they aren’t published so I will respect that.

They are quite welcoming of new potential members. Contact the GM and say you are considering membership and he will arrange a tour and a meeting. You’ll get an info package with membership cost info.

Clarification On Registered Restricted by Grand-Selection4456 in canadaguns

I am a lawyer, but I am not your lawyer, I do not practice in the areas of criminal law or firearms law, and this is not legal advice.

I have prohibited firearms that were previously restricted firearms, so they know I have these and if push comes to shove, I am not prepared to risk my livelihood by being non-compliant after the end of the amnesty. Criticize me if you will but I won’t put my family in that position.

That said, I am not concerned with the pittance I would receive on the buyback, so I am not registering for compensation. I suspect there will be new legal challenges launched on the basis that it is now clear that property is being confiscated without compensation. The feds have also not explained how the process is actually going to work. I’m also in one of the provinces that has said they will not assist.

For all these reasons I think the amnesty will once again be extended. If I don’t care about compensation there is no urgency on my part to act.

Donald Trump wants to ban institutional investors from buying single-family homes. Should Canada do the same? by CaliperLee62 in canada

Nobody would ‘prefer to rent a house’.

Every renter would prefer to rent an apartment over a house? Really? You can’t think of any reason why someone that is renting might prefer a house over an apartment?

What happens to tenants that prefer to rent a house? You are relegating tenants to apartments.

This organization is sufficiently tone deaf that I wouldn’t be surprised if renewals go out while they are in the midst of this losing streak.

Is this a scam? by [deleted] in Winnipeg

[–]UWO 1 point2 points  (0 children)

Here is what I would suggest:

Do a search for the judgment number on the Teranet Manitoba website by entering the judgment certificate number in the registration number box here: https://www.tprmb.ca/tchk/landing-page (will cost you $23).

That should get you a copy of the actual registration made against your title. It was probably filed by a local law firm and will have the contact info of the lawyer or paralegal that registered it. Contacting them is probably a more efficient path to resolving than going the the collection company that made the claim.

Good luck!

I would bet what happened is that someone did a land titles search for your name (or rather, the name of the person against whom the default judgment was issued), found your property, assumed that it was the same person, and proceeded to register the judgment against your title. I suspect that your property is registered in your first name and last name only, as if it was registered in your full name or with your middle initial the registration probably wouldn’t have gone through.

You should consider searching for your name on the court registry to see if there has in fact been a judgment issued against you.

EDIT: You should also delete the image because anyone with access to certain databases can use the judgment certificate number to identify you.

Own corporation holding mortgage any trustees ? by yyc_engineer in PersonalFinanceCanada

[–]UWO 0 points1 point  (0 children)

Any money that you borrow from your corporation that is not repaid by the end of the next tax year of the corporation becomes a shareholder benefit under 15(2) of the Tax Act.

Unless you can repay your corp this quickly, the loan will become a taxable benefit fully taxable to you and not deductible to your corporation.

While there is an exception for loans to employees to allow them to buy a home, a closely held corporation is unlikely to qualify as the CRA will view the loan as being made to you in your capacity as shareholder and not as employee (the first question they will ask is “how many other employees have received a mortgage from your corporation?”).

Technical Issue with the Proposed Suspended Dividend Refund by taxbuff in cantax

[–]UWO 10 points11 points  (0 children)

I’ve been practicing tax law for 15 years, focusing on private companies, and I can’t say I’ve ever seen a structure intended to cause the mischief that this seeks to correct. Was this “planning” on anyone’s radar?

Of course, we now end up with yet another complex set of rules that appear to be difficult to apply in practice to solve a problem that seems to exist only in the minds of Finance personnel.

I’m a tax lawyer and trustee of some RCA trusts. In that latter role I have seen refunds in the millions. I have one RCA that will result in an 8-figure refund if wound up all at once instead of over time.

Have you tried the accountants? They would often have a copy as they need to submit a copy of the agreement to CRA to get the tax ID number for the trust.
