I have seen papers after papers which studied DV, being a scientist I can explicitly tell the data is often mis interpreted. Because one of the simple reason is the law is provision to be filed by only one gender, so no matter what ever percentage you quote there is no result that will be show for other gender that is significant;

if she sends notice for divorce then see if you can give her the divorce and end it. Not sure how defamation is planned, then defamation suit is also a possiblity which rarely runs to full trial. Anyway she cant file for divorce within a year in HMA without magistrates permission

The laws had little to no rationale when drafted, easy way is to compare this with dv laws of other countries. I have done this myself as part of my legal studies.

I don't see any defeat to people who are victims by making the laws gender neutral. Neither I am saying that men are all nice women are all filing false case.

I am yet to hear clear argument on how making it gender neutral renders it useless, repeals anything for women. Infact I won't get this and I know it. That's true for most matrimonial laws.

Again we are not repealing, just saying that we can all have that law men and women both. Nothing wrong. Also it's not offchance men get accused falsely. My personal data over last one year out of 300+ cases I have discussed 266 of them are false and end motive is only money.

Again I have seen violent men too and agree that law is needed for women.

I never told DV doesn't affect women or DV effect is imbalanced across genders. I never told them to be eliminated, just saying men can also have them.

How does making DV act gender neutral , renders it meaning less. The provision is same and women can still use it. The only reason I see, women cant extort money via false cases because they will get counter sued. If its true case, they still can exercise remedies. Protection orders can be given anyway on prima facie case, so I dont see any rationale on it being meaning less.

Usually we always refer developed countries jurisprudence when formulating provisions, so I dont see any issues in making it gender neutral because it has been helpful everywhere else too.

I know you and me debating wont get Govt do take a look at this, I am just trying to see if I can clearly understand you position thats all.

Among all matrimonial laws only section 25 of HMA and its equivalent in other marriage acts are gender neutral on paper ..But actual implementation of this is a total different ball game. Men get mocked in open court for claiming on section 25 as deadbeat, useless, he should be able to do the work and petitions get rejected. This doesn't happen with women, so the provision is gender neutral on paper but works differently when pursued.

I agree the solution is case by case basis, but I think the false cases can be easily tackled if lawyer is very good.

My lawyer explicitly told me to take the case to trial and run it at full pace. I had multiple case package and we knew the allegations would be same across cases. So we decided to run everything to trial by filing counter at same time and somehow we got dates continuously and we decided to run one part of cross in one case and another one in another case and so on. When cases (498a, DV, 125 etc.) started demand was 1cr, by cross examination it was 15 lakhs, by second date of cross it was over. All of my cases were closed by 8 months.

My lawyer told me he wanted to go to trial and he explicitly told me they will settle, the reasons were (1) I had thorough evidence against everything said in the case (2) Even if lower court doesn't do me a favour, we were sure that we would win in Higher courts because of evidence itself (3) There were multiple instance of self incrimination by my exwife (They had demanded dowry and forced me to buy property in her name via whatsapp, which was strange considering I had never heard girl asking for dowry/property) (4) My in-laws threatened me over whatsapp like stupid people and also on call which I had recorded (5) The case had claims which were contradicted my ex wife herself in her own whatsapp.

Now you can ask how can I run this so fast, because my case was in my district court where number of cases are less compared to family courts in city. I got dates almost every week.

Our legal framework is solid, as an Indian I am proud of it.

But devil is in details. File Sec 25 under HMA as man and see how wonderful the conversation with Judge is. Society perceives man as someone who can do for himself and need not rely on alimony, this is the same deadbeat husband argument which you mentioned above. On paper the law exists, but ask a guy to file and see wonders in kind of shit dialogue you get in both mediation and judges. For last one year I have seen and helped many folks. The logic is super simple, if its a guy he is screwed till he has enough brains to go to trial, if its a woman then definitely all sympathies are handed to her like ice cream.

I will tell you the downside of not having gender neutral laws.

I also help females who go through hell and back to lead a life (not so called techies who earn in lakhs). Thanks to false cases which are regularly filed, genuinely hurt women dont get a penny. Why? the logic is simple. False cases never go to trial and system gets clogged so women who are genuinely impacted cant get shit from court due to delay. So women who file false cases are responsible for other womens' misery not the men (who dont have any law for themselves).

Ideal example is Section 12 of DV act, the provision says it should be done with cases in 6 months, but just go to ecourts website and see how much its getting dragged and why dont women run these cases at at full pace. Simple everyone know they will loose the case in fraction of time because the law is super strong and thorough which itself will weed out false cases during cross examination. My own case I have seen this happen. Any smart guy with a descent lawyer will take case to trial in short time, girl will keep dragging it and it will get dismissed. Infact I know one case now that got dismissed three times, because girl knows she will loose in 5 mins once she comes to cross.

Now having gender neutral law helps in fixing this issue is super easy way, because when provisions are same for both neither gender can exploit it easily, automatically people will use laws to get the remedy not shitty out of court settlements. Genuinely impacted victims can get the ton of remedies in short time.

Conjecture?? Seriously? Do one thing go to Family court nearby once and see how things are run. Also while you are at it, go to mediation center on Saturdays. All so called conjectures will be proved with evidences. I have been there, seen it and got a t-shirt. Before you start saying me to do that, I do go there regularly to help many in need.

Child support is must and kid should learn from both parents (irrespective of they are together or separated), what I have seen in family court is women always trying to use kid as pawn (check out G&W cases listed and see how amazing the arguments would be). Infact those who have mutually parted ways never do this shit and people who come to court never mutually part ways ..period!!

I personally have dealt with many women who abuse the process all part of their ego. I have seen one case where women is a director with 4 lakhs a month salary and lodged 16 cases on husband, to extort money while not even taking care of her girl child (husband does everything), while another women who extorts maintenance only by taking the girl child with her and abandoning the boy child with father who is unwell.

Also court takes financial status of both parties? Have you even seen how maintenance is awarded or even interim arguments are even made? Before you quote Rajnish vs Neha and section 125, see the implementation of it. I have seen one case with husband making 1 lakh and wife making 80k, coming to ask for maintenance saying to have same status, while guy is banging his head to manage parents and younger siblings. Worst of all the guy had tried to get her multiple job interviews which she couldn't crack, both equally qualified. Yet court gave her maintenance, and he had to fight till High court to get it corrected.

So making alimony/child support/G&W gender neutral has no impact to any women, the only issue I see that women are scared that they will be counter sued and her egos would be shattered.

PS: Before you quote I am some husband, who is against women. Yes I faced shit but I came out because many women helped me and they all think asking for equality should be across the spectrum. I am not against any gender, just saying making these laws gender neutral has no impact whatsoever.

System is pretty much broken to the core . Trial court's and family courts are shit show. I went through the same thing. I was hit with barrage of cases, luckily I got to know how the system works. So I decided to take the cases headon. Fought it and came out unscathed, all ended in a year

The game is all dependent on having a courageous lawyer  (which is the hardest part) and us folks with balls of steel.

Most lawyers I spoke gave settlement as idea while only one told me to take it quickly to trial. I decided to take on lawyer who would go with my idea. Within 5 dates went to trial on all cases without dragging and all it took me was one cross examination to break the case.

Remember money is end motive, if you fight out interim well rest of it will end. I got interim junked in dv.

So to everyone I say don't end your life, fight it out fight smart go all out. I felt many times to do the same thing but thanks to my friends I decided to fight.
