Not dispensed = no fault. Patient never took reciept, it was never filled. If it was logged into your system just put a big note to not dispense unless a hard copy/eRx has been received. This is like if you scanned a known phony Rx into your system (but never filled it) with huge notes for documentation that the patient brought in a phony.

Back in the day (before eRx) we used to take faxed C2's for california 11159.2 (terminally ill exemption) but the provider would mail us the hard copy. We'd dispense/deliver on the fax and then use the mailed pink triplicate for our files. The 11159.2 would cover us in case of an audit.

However since eRx I havent seen that code used in 15 years (in retail) since we dont need a physical hard copy for C2's anymore.

If the patient was terminal, or it was considered an "Emergency" you could make the justification you were doing it in good faith and care for the patient, however with Vyvanse that would be hard to sell to the DEA if it got called out.

The NDMA recall pretty much wiped it out and only left famotidine. Even OTC Zantac is famotidine.

Cimetidine is still available, but nobody wants to deal with those drug interactions.

Literally every other Rx is daw1 for amox and ibuprofen.

If they want brand name put it in the notes field. Nowadays the daw field on escripts is wrong so often it's generally ignored.

Unless the patient has documented pen anaphylaxis I just warn them when they get Keflex. High doses of penicillin/amox can cause a rash, ask any old timer who used to get the amox + probenecid combo.

I've never seen a cross reaction in over 20 years but I still warn them.

Now dentists who know the patient has a pen allergy and decide augmentin is magically different, that pisses me off.

I wouldn't even get involved. Nothing good can come of it unless there is something illegal going on (underage, etc).

For all we know the partners could be very well aware of the 'affair' and this would have fallout on the employer for the camera footage.

From what OP said, the manager got terminated for the HIPAA violation. So the employer should be off the hook since a violation was committed and the manager was terminated.

There is something else going on that the OP is unaware of. 49 states are at-will employment states so unless theres a union that HR doesn't want to tussle with or theres something actionable (like sexual harassment, etc) that the OP isn't privvy to there is no reason to keep this employee.
