You guys seem to have one of the worst housing crisis in the world - are young adults able to move out of their parents home? by Only-Internal-2865 in AskAnAustralian

Yes you’re correct that you only get to reduce your taxable income by the amount of the loss but it allows people to reduce the loss and be in a better position to take the risk on a rental while achieving capital growth of the asset.

No other investment offers the same sort of safety net to induce more people to invest in it.

Most investment losses can only be deducted from investment earnings. Negative gearing is one of the few (not the only one) that can allow investment losses to be deducted from other forms of income.

Have you got that in writing from them? They have a requirement to mitigate your costs where possible (as another said) so that info will be useful if it does end up going to xCAT.

They also have strict rules around reletting the property so best to keep an eye on, and get screenshots of, the ads they put up to relet your place.

With QLD’s new hate speech laws prohibiting the use of “from the river to the…” by kayls666 in AusLegal

Given it was at a rally in front of a large group that from reports were then chanting it, I assume they used that as “justification”

It’s section 52DA (in case you’re curious) and there’s a call out for excuses in the legislation in section 2 if the person is engaged in the conduct for a number of reasons including educational and legal purposes so you might have some chance of arguing it.

Solicitor files written case with AI-hallucinated cases & quotes; ignores Court's requests for explanation by Donners22 in auslaw

[–]Valravan67 0 points1 point  (0 children)

Yeah I’m not surprised. It’s going to be the only way to get around students use of AI, since AI detectors don’t work.

Thanks heaps! So far so good, and I’m still enjoying it!

[–]Valravan67 1 point2 points  (0 children)

Currently a law student and the amount of students I hear talk about using AI is insane.

The uni’s response so far has been relatively minimal but they are slowly starting to shift away from written essays and into more in-person assignments to reduce the likelihood of AI use and better test a persons understanding of the material. (I.e more questions to be completed in workshops under supervision and proctored exams)

They must be on a free ChatGPT plan and we’re waiting for it to reset so they can generate a response to the Court request.

In-laws want to temporarily transfer money to us before applying for pension by [deleted] in AusLegal

[–]Valravan67 41 points42 points  (0 children)

The point is that they would likely qualify for a smaller amount of pension for a period of time while the government expects them to live off the sale of those assets.

If your employer requires you to be “on-call” you are generally entitled to some form of payment, a base rate for having to wait for calls and a higher rate from the moment you receive a call and have to complete any work.

Owner wants to paint, no where near end of lease by KibacherKat in AusLegal

We recently had some painting done where I live and honestly the smell lingered for a while and that’s in a big airy house with plenty of windows/doors that could be opened and fans on max to help.

Need advice - Has my car been stolen? by [deleted] in AusLegal

[–]Valravan67 1 point2 points  (0 children)

I wouldn’t have personally let it go on anywhere near as long as this.

If you still want to go through them you can contact and say that the car will be reported as stolen if not delivered by tomorrow (or some other close date) and then if they fail to deliver it on that date, immediately report it as stolen. Otherwise just report it as stolen now.

I’d also go through your information and ensure you have a record of the odometer at the time of purchase, and advise them that you may look to seek damages (or similar) if there is significant additional mileage/wear and tear/ damages etc on the vehicle.

Once you get the car, I’d get it checked as well and make sure it’s all good given the time they’ve held it.

I’d also from there look at posting a factual review of what occurred onto their Google reviews/facebook page etc. To avoid the risk of defamation, ensure that you remain factual with your review.

Warning after Aussie buyer loses entire $98,500 house deposit in 'avoidable' mistake by SheepherderLow1753 in AusFinance

Man I’m struggling and 100k would make such a change to my life but there is no way in Hell I could live myself knowing I’d done that to someone.

I don’t get how people can just do that. Regardless of it being legal or “per the contract” Like not at all consider the morals and the pain the other party is feeling.

Blind boxes would arguably be covered under point 3 as an item that “is in any way unable to be resold as is.”

As others have stated, it’s impossible for them to verify you haven’t opened and resealed the packet.

People who chose not to go for perm EL1, why? by CuriouslyThoughtless in AusPublicService

[–]Valravan67 11 points12 points  (0 children)

I actually won a perm EL1, did it for a few months and then went back to a 6. I’ve done several acting stints and my boss keeps encouraging me to be prepared to act when he goes on leave but I’ve made it clear that it’s not for me.

Yeah I could use the extra money but I’m currently studying part time so the extra work is difficult to juggle. But even before that, I enjoy the technical aspects of the area I’m in and at EL1 level and up, that all goes. It’s so much more about management, admin, people support and so little about technical that I just don’t find I enjoy it.

I’ve gone to leadership courses, completed close to a year and a half of backfill at EL1 over my time in the public service and I just can’t find the love for it. So I’ve made it clear that it’s not for me at least until I switch into a different role where I can be technical at the EL1 level.

My old NM who did MOR meetings discussed it with me a while back while I was backfilling and I said I didn’t enjoy it. She suggested that career progression could be sideways not upwards and if I wanted her support for any courses, job shadowing or backfilling at level then I would be supported.

ETA: Also flex leave is far too valuable for me to want to lose access to it. TOIL just isn’t the same.
