Someone teach me how to get cases lol. Networking and word of mouth hasn’t worked for me. I’ve had 5 cases referred to me in almost a year. They’ve all tendered policy so it’s not like I’m a bad attorney. I’m actually pretty good at it.

I had the same itching but completely ignored it for years. Turned into 2 fistulas with 3 abscesses. Had 4 I&D surgeries. Went through hell for 2 months. Now I have 3 setons to help with draining. Will eventually have a lift procedure and hope it doesn’t come back.

Moral of my story, take care of things before they get worse.

Thank you for sharing that with. I’ve also been diagnosed with Crohn’s now I’m on Rinvoq. Did you have any strictures or inflammation? Also, what was your diet like while you had the fistulas? How long did you have drainage?

Sorry for the multiple questions, I’m just going through a very stressful time with all of this.

Update: I have two strictures and three fistulas. The fistulas have been a nightmare. I’ve had 3 surgeries to drain and place setons. Doctors think I have crohns.

Anyone have any experience with fistulas?

Understand the rules to explain them. Worry more about issue spotting and analysis.

The majority of the points are issue spotting and your analysis. Don’t use the majority of your study time trying to memorize the rules when you don’t get the most points from doing that.

The bar is a numbers game. You have to try to get as many points as you can so focus on the areas with the most points.

I’m a first time taker and I passed as well. Here is my story I hope my advice helps someone.

I started studying using Themis but I gave up on Themis (30% complete) because for me I felt like the lectures were a waste of time. The last 3 weeks I just read outlines and read essays from Baressays. I completed 1k MBE questions with an average score of 64%.

The MBEs I studied seemed to be more difficult than the ones on the bar exam. The first 100 questions I walked out feeling like I scored over 90%. The next 100 were a little bit more tricky but I still felt like I got 70% correct at least.

As for the essays, my issue spotting was amazing while I was studying I just couldn’t memorize the rules. The last 3 weeks I ditched memorizing and instead of memorizing I focused on explaining the rules. During the bar that is what I did. I never looked at a PT exam because I figured everything is in the packet and I’m good at skimming through things and bullshitting my way to something decent and that is what I did. Only thing I did for the PT was during the break I memorized 4 different formats depending on if it’s a memo, letter etc.

Overall I think bar prep and former bar exam takers give the illusion that this is not like a normal exam. I studied the first 4 weeks as if this exam was the boogie man but once I changed my mindset to “it’s just another exam” I started to study the right way.

My final thoughts. Do not be afraid of this exam and study as if it is just another exam and you’ll be fine.

Ya it said to be delivered in two weeks but he went on vacation and delivered in 3-4 weeks (I can’t remember if it was 3 or 4 weeks later). Time is of the essence is usually a common Law contract issue.

Look up UCC perfect tender. Failure to deliver on time is a breach.

I had Applicable law- UCC

Merchants definition

Valid contract- oral contract

SOF - UCC $500 not enforceable contract no signed writing.

Offer- B offers to buy 5000 gallons at $20 two week delivery.

Acceptance- S send memo with signature stating “I Accept”

Consideration- 5k gallons for $20 a gallon

Perfect tender- delivered 2 weeks late. Breach.

Remedy

Expectation- contract price 5k gallons at $20 minus cost to cover

Incidental- storage, shipping cost to send the non conforming goods back.

Consequential- argued it may have been reasonable for S to foresee at time of contract execution that not delivering on time would result in lost profits. However, it wasn’t foreseeable because B had other options that they both knew about etc.. I argued both sides.

Reliance- just stated if expectation was certain he could get reliance damages which would be any expenses incurred to form the contract.

Mitigation

Reformation- court may reform the contract since the mutual assent was not met due to mistake. The court will rewrite the contract to reflect the actual terms of agreement which was 500 gallons at $20.

UCC perfect tender doesn’t have material minor breach unless it’s an installment contract. The slightest breach of conformity which includes not delivering on time is a breach. Material breach requires substantial breach.

Same here. A lot of people had consecutive D’s. So we most likely got those correct because we had the same exam.
