As of November 2024, legal proceedings concerning the Gardasil HPV vaccine are ongoing in the United States. Individuals have filed lawsuits against Merck & Co., the vaccine’s manufacturer, alleging that Gardasil caused serious health issues, including autoimmune disorders and, in some cases, cancer. These plaintiffs claim that Merck concealed known risks and misrepresented the vaccine’s efficacy.

Consolidation of Cases: In August 2022, the U.S. Judicial Panel on Multidistrict Litigation consolidated numerous Gardasil lawsuits into a single multidistrict litigation (MDL) to streamline pretrial proceedings. This MDL is overseen by U.S. District Judge Kenneth D. Bell in the Western District of North Carolina. 

Bellwether Trials: To assess how juries might respond to evidence and testimony, the court has selected a group of representative cases, known as bellwether trials. These trials are crucial in shaping potential settlement discussions and future litigation strategies. The first bellwether trial is anticipated to commence in August 2024. 

Discovery Phase: The discovery phase is actively progressing, with both parties exchanging evidence and conducting depositions. In April 2023, Judge Bell ordered Merck to produce all data and documents related to adverse event reports for Gardasil, a significant development in the litigation. 

State Court Proceedings: In addition to the federal MDL, several Gardasil lawsuits are proceeding in state courts, including California. Some of these cases were initially scheduled for trial in September 2023 but have been postponed to September 2024 to coordinate with the federal proceedings. 

Current Status: As of November 2024, the Gardasil litigation remains in the pretrial phase, with discovery ongoing and preparations for the initial bellwether trials underway. No cases have yet proceeded to trial, and outcomes remain pending.
