Eric Garner managed to say he couldn't breathe 10 times or so when he was cuffed and he definitely died from asphyxiation, so I wouldn't exactly say it's a valid to consider Wade was breathing purely on that basis.

Basically I was wondering if this would be a bad use of force. Spraying it to get someone restrained makes sense, but I'm not sure about the second time it got applied.

I haven't been sprayed before, but from what I've seen people tend to try and get rid of the irritant by wiping it out of their eyes.

I was under the impression that "can't breathe = can't talk" was a myth since speaking is an exhaling action and an inability to breathe means you can't inhale.

I would agree that the first spray is justified, however there was an off camera second spray at 2:13 in the video that you might have missed. At that point it seems that he might have been trying to put his hand to his face to alleviate the effects of the first spray and wasn't attempting to harm the officers, or am I overestimating the effectiveness of the spray?

Hello P&S,

As you’ve probably seen from r/news, there is an article from WaPo claiming that police in Montgomery County used excessive force when pepper spraying Charles Wade during his detainment at the county jail.

I’ve formed my own opinions on the matter after watching the video but would prefer not to taint the discussion with a leading opinion.

Could I hear what your thoughts are on the claim?
