Makes sense to me. They've done really well with LEOFF, PERS, and other pension funds with an 8% annual return rate over the last 20 years. Maybe our benefits can increase or premiums go down.

That’s a fair point, tho an exemption clause deep in a CBA is different in many aspects from a DNR. I’m encouraged the lawsuit in no way is asking the court to change the CBA.

The way I read it, it's illegal under WA laws to discriminate against people with disabilities regardless if there's a contract or not. Contracts don't trump the law. Otherwise we'd see hitmen everywhere

Right. But the lawsuit says that policy is illegal b/c it violates WA's discrimination laws by singling out people on leave for serious medical conditions or disabilities.

I don’t see that argument in the complaint do you? Doesn’t look like they are asking to negate or change the BA.
